Thanks for the advice guys; my beer eye was acting up :) We all make mistakes. This mistake did lead me to a successful career which I’m very thankful for today and would not change the past. Things happen for a reason. I do read on this forum a lot since I filed the petition. The act of crime wasn’t aggression of any type and no drugs were involved. At any rate, my fiancé knows about it and I will have the official documents ready. I will make sure she has all the documentation if we make it to the interview. Just to be on the safe side I will give them a call. I was a bit confused when I searched because I didn’t see anyone who selected “no” and what the outcomes were from a DUI point of view. I also wasn't sure about question 4a on the old and new I-129F fourm.

I don't know if they will send an RFE for that.  I had a very similar situation.  We received NOA2, had a successful interview and were denied during AP after the interview.  In my case it was a 30 year old misdemeanor arrest that was dropped and later expunged.

I would contact USCIS and explain and hopefully they will allow you to amend the petition.

Interesting, I’m curious…Did the USCIS send the information from your background check to the Manilla embassy? If you selected no and the USCIS found something in the background checks why didn't they ask for more information???? Did your fiancé have supporting documents (and was aware) in hand of your past crime when she went to the interview?

It was found in AP. That is NVC. USCIS approved us. We had no idea. RapidVisa told us it wasn’t needed. We had no backup because we thought we were good. They never asked about it either. They congratulated us and took our passports.
