Timeline

EAD is 4 to 6 months, not sure I have seen a case that used prio Biometrics, did not know they did that.

~4-6 months on average. Sometimes shorter, sometimes longer.

I never heard of reusing old biometrics, but it's also not something I follow.

Not seeing the urgency to respond...the EAD will come when it comes.

Well that is how long iot takes now to get EAD, best thing we have to go on.

There are various ways to get an EAD when filing VAWA.

If you only file the 360 then it is category c31 and the EAD will be issued after the 360 is approved which can take 6-12 months or more. Currently people are getting notifications their EAD is approved and being mailed several days before the case status shows 360 approved. 

If you filed 360-485-765 then you can get an EAD under category C09 - which means about 4-6 months after NOA.

You can also get EAD based on defered action (rarely used) after 360 approval.

Often people who file VAWA have previously filed AOS packets with their abusive spouse and recently did biometrics for that AOS packet. Sometimes they use those "old" biometrics and do not make them go for prints again.

I think my attorney filed under c31 :( although I filed 485 and 765 as well

@betelgeuse refresh my memory about your situation. Did you get 360 approval yet? Did you have a previous 485 or 765 pending or 765 approved? Who filed what and when?

 

On the 360 is an option to get a work permit. Its a somewhat new addition to the 360 form. Its just a simple one question box if you want a work permit. Checking yes will cause them to issue a c31 permit when 360 is approved. Still a lot of issues with this option being added and people are getting both the c31 and the c09 permits. (easy to fix though and not a big issue). 

If you are waiting on c31 you just have to wait. If you are waiting on c09 you can ask for an expedite based on financial situation (you most likely qualify if you are unemployed and have no source of income) I can link a current thread on those attempting to expedite if you can not find it.
