November 2018 AOS Filers

Got my text messages last night, and also my case updated online stating that fingerprint fees were received. Hopefully I get the biometrics in the mail with the hard copies of my acceptance hehe.

Heya!

 

We are about to file our AOS packet in the next couple of days.

 

I just had a question for the supporting evidence for the affidavit of support.

 

Did you include 3 years of Tax returns (form 1040) AND W2's?

Or just the W2's?

 

As I only took W2s to my interview and that seemed to be fine, :)

 

PS bring on AOS. Is anyone else dying to work? hahaha. (i'm a workaholic time off is hard for me)

The I864 requires only the most recent tax returns. You can send 2016 and 2015 if they help prove your financial stability but they are not required.

 

1. If you send the 2017 Income Tax forms and all schedules you will need to send the 2017 W2's as well.

2. If you send a 2017 IRS Transcript you do not need to send the W2's as that info is already embedded in the IRS Transcript.

 

In any case, you cannot just send the W2's as evidence of the tax forms. This is a guaranteed RFE.

 

*the I134 required for the K1 interview and the I864 required for the AOS application are very different. The I864 is a legal contract between the sponsor and the US government stating that if the AOS applicant should become a public charge, the US government has the rights to sue the sponsor. The supporting documents for your specific financial situation that you provide to prove your ability to support the applicant are very important and they will be reviewed and investigated fully. Follow the I864 instructions very carefully to avoid an RFE.

So are you saying that it would suffice just to hand-in just three years worth of tax transcripts? I handed in W2’s along with my husband’s transcripts as they took both of these during my interview.

 

I hope I submitted the right things and don’t get an RFE.

So most recent tax return would just be the 2017 one correct?

My husband doesn't have copies of his past returns on hand do you know if he can just call the tax department and have them emailed across?

What I'm saying is the W2's are useless by themselves without the corresponding Income Tax forms.

 

You DO NOT have to send in three years worth. You must only send in the most recent tax year. The other two years are optional. 

 

You sent in three years of IRS TRANSCRIPTS. That is totally fine but not necessary. Even more not necessary are sending W2's along with IRS Transcript. The IRS Transcripts CONTAIN the W2's already so they dont need them. 

 

You wont get an RFE for sending TOO MUCH information like you did. You WILL get an RFE for sending the wrong information or not enough documentation.

He can either sign up online and print any of the last three years here or have them sent in the mail if he doesnt want to sign up:

I doubt it you would just need to wait. If you don’t get it in say like 30 days you will need to contact them.
