If you have a gc you don’t need ap.

ead and ap are temporary documents while you wait for the gc. If you have gc you’re a permanent resident and can work, travel internationally, etc

Thankfully our tax return is due to be paid tomorrow. Had a whole thing with H & R block - lady asked my husband to forge her signature. Got rid and went to Turbo Tax. They said that you can file electronically if you have a SSN (we originally thought we had to paper file). If not, you can get an ITIN number. Took 2 weeks. Hopefully more of us will get tax returns to keep us going - you know 'spoil' ourselves for a split moment with $$$. Really rooting for all us November filers for EAD/AP and getting our interviews scheduled soon ❤️

When you filed your taxes do you end up filing married jointly or married separate? Did you have to as well submit a separate letter to the IRS stating that you want your spouse to be considered a permanent resident for tax purposes? I’ve been trying to research which is the best way before I meet with my accountant and file. My husband does have his social security number as well

We filed married jointly. They are happy with a SSN for the beneficiary as all they need is something to link your spouse to. However, Turbo Tax did advise in a case that a beneficiary doesn't have a SSN, then to use the ITIN route. But, I'm only realizing that it may take a number of weeks to obtain a ITIN.

My husband (petitioner) also said that Turbo Tax said in case of not having SSN, they recommended people to go make an appointment with IRS Taxpayer Assistance Centre for ITIN. They said that was an easier option in their opinion to avoid having to mail proofs of identity and status documents etc...

MFJ is more financially beneficial. He will need his SSN.

Yes you need to write a statement stating the nonresident alien elects to be treated as a Resident Alien for tax purposes for the whole year.

Hi guys!  Does anyone know when we get our SSN?  I haven't heard anything from EAD but they've already scheduled my interview.  So just wondering if I will get my SSN when I get the GC...We want to do our taxes soon but not sure if we file for ITIN or wait until I get SSN.

If you get your GC I think you might have to go into the SSA office yourself to apply for your SSN because the request for one was only on the EAD application form, but I'm not 100% on that.

When is your interview? If it is soon you might be okay, if it is a month away then it might be a little risky, I don't know the consequences for late filing or how long it takes for your SSN to come through once you have received your GC.

 

You may already know but with an ITIN you have to send off your Passport or other important official documents (or get copies certified by a Tax agent - highly recommend it rather than sending the originals off), and it can take 60 business days for them to send the documents back to you (you file ITIN at the same time as your tax return so don't worry too much about the sixty days).

 

It's all speculation on my end though; I have no SSN either so will have to go the ITIN route; there's no way I'll have my GC interview in time, even if the status changes today.

If you did not apply for your SSN and receive it before marriage or before your I94 expired, you would have to apply for it on your I765. Once your EAD is approved and sent to you, you can expect the SSN to be mailed within a few days.

If your GC comes first, your SSN application on the I765 form will be abandoned and you will have to apply in person at an SSA after you have your GC on hand.

I'm literally so bored that I'm constantly checking timelines for EAD/AP approvals LOL!! I wish there was a way we could do weekly approval graphs for November soon, just like K1's. If I was smart enough I'd volunteer to do this/if it was even possible

Soooooo either wait for your GC or apply for an ITIN in person at a local IRS office so you dont have to give up your passport. Or ask for a filing extension for your taxes. Or have your spouse file his taxes seperately and then amend them after you receive your SSN.
