This might be helpful too in understanding what needs to be sent for a self employed sponsor.

It's a excerpt from the I864 instructions.

Submitting an earnings statement is not enough. Tax forms are required. On the I864 form Part 6 Question 23 states this (pictured). Notice the "MUST".

 

Also, you did not mention if he filed taxes or not. In order to be a sponsor they must have filed taxes for the most three recent years (and at least provided a copy of the most recent taxes) OR if they did not earn enough to have to file taxes you would have to check Part 6 Question 25 and write a statement stating why you did not have to file taxes in the three most recent years.

 

Once USCIS doesnt accept what documents you sent (ie you did not send them what was required to support/explain your financial situation), they automatically tell you your income isn’t sufficient not because it isn’t sufficient, but because you haven’t proved it to their satisfaction. 

Note that it says: "based on the documents you sent" in your RFE

He did file taxes, it all goes through an accountant so it’s all consistent and has been since he started at his job 6 years ago! Idk if you saw either but he submitted a 1099 and also submitted an income tax form from recent tax year 😕 (just asked him to confirm). So idk, I’m confused still haha. Either way, I’m glad we’re able to resolve it through his dad becoming a joint sponsor. Otherwise we’d be pretty #d

Oh man. We didn’t submit an IRS transcript, maybe that’s why? Honestly I don’t understand taxes very well, so all of this is completely new and confusing for me. But he is classed as self employed, so something there, somewhere, has gone wrong. Whether we submitted documents incorrectly or didn’t submit enough

Sorry, if I misread or misunderstood but your post did not make mention of submitting a tax return or transcript and only mentioned a 1099 which is an earnings statement and not an actual tax return or return transcript.

Can he confirm the tax return he submitted was absolutely positively complete and included every page and schedule the accountant filled out and not just the form 1040? If it wasnt a complete copy that could be why too.

No it's either/ or. An actual tax return all pages and schedules that was submitted to the IRS to file taxes plus all corresponding earnings statements that are reported on that same tax return OR a Return Transcript that you would request from the IRS after your taxes have been processed and act as a condensed receipt of the submitted tax return.

Likely because his tax situation is very complicated due to being self employed he either did not have all pages to submit in the first place or they lost some pages. That's why its easier to submit Return transcripts instead as a tax return can contain 100s of pages if you have a complicated financial situation while a Return Transcript would likely have less than 10.

Hi @Penny&Lee my husband is also self employed. We sent FULL tax return with all the shedules ( around 50 pages) plus I included Tax transcript also. Didnt send previous years. 

So far I didnt hear anything from USCIS. 

I feel like you guys just didnt send full tax return. Alot people think its only 1-2 pages, but it not:) 

Your RFE is very generic one. Whatever is missing it will always says “you didnt meet 125%”. 

At least you have a co sponsor in line. You will be fine:)

No it's either/ or. Yeah it sounds as if we didn’t send enough based on everything you’re saying. Good to know! I mean there won’t be a next time but it’s relieving in some sense to know it was an error on our end. Thank you!! Glad it’s a very generic RFE however and easily resolved

Yeah we definitely didn’t submit 50 pages. Maybe 10, if that. It does sound like we didn’t send a full tax return, bummer but atleast it can be easily fixed. We won’t go down the road of correcting everything because still then we could have another issue due to it being so complicated.

Do you know if we are supposed to get another update after the “card was mailed to me” status? I called USCIS and they said they don’t have a tracking number assigned. I’m just getting a little too excited 😆

On egov.uscis.gov?

Yes. On there it usually goes...

Card was mailed to me.

+a few days, Card picked up by USPS

+1 to 3 days, Card was delivered by the Post Office.

This week has been a toll on both Matt and I. I just keep thinking "this is gonna be the day" and it keep not being the day. I'll admit that I'm a bit of a freak and know my birthday is the 160th day of the year. Today is day 160 since our recorded RD on Case Tracker and I guess that's just freaking me out even though I know there are people who have been waiting much longer than us. I think its even more frustrating knowing that if Jan the intern hadn't misplaced the BC while receiving the case we'd probably be expecting our green card interview at the end of the month. The waiting game is taking enough of a toll on me that I've lost almost all motivation and focus at work. Its felt like an elephant has just been sitting on my chest for the past three weeks, and it keeps getting heavier every time someone asks whats going on with it. They'll know when I show up with green cupcakes.

 

Matt's being a real champ about the whole thing. I should be the one making him feel better, but its been the other way around. I was feeling really stressed out about it on Tuesday night that we went to a frozen yogurt bar and I ate my feelings in cheesecake froyo topped with more cheesecake, brownies, m&ms, and reese's pieces. I know he's getting very antsy with not having worked in so long, but he never lets it show. He's also been dealing with what's probably the worst allergies of his life at the same time so I know I picked a winner husband.

We aren't as far as you (day 147), but I've felt quite similar recently. We have more and more discussions at night about how frustrated we are, how ridiculous the whole thing is, blah blah blah. Both of us are having a hard time looking forward to events/outings and relaxing on the weekends. I also have become obsessive with the whole thing (I check USCIS about every hour - the app, both sites) and VJ is always open in my browser. My partner has also been really strong - but the frustration is getting to him. We're both becoming a little desperate, and every time he goes out to check the mail it breaks my heart. His friends and family have difficulty accepting that this is just the situation. Not the best impression of America so far, unfortunately. 

 

I suppose it helps to know we're not alone - we're all going through this INSANE process together. But I just wanted to say I empathize with you and validate allllllll your feelings - it really sucks. :wacko: I'm sorry you've had a rough week. I hope next week brings better news!

It is encouraging to come on here and see others waiting. We are 145 days. I just dread waiting 160 or more. Really hoping next week we will hear something, but also realizing fully it could still be a wait. I think the push now is because I recently resigned from one of my jobs. The one brining in the most income. I just can’t physically handle doing all 3 jobs. This is hard for my husband who wants to be the one supporting us. I’m a certified nursing assistant and he hates to see me coming home in pain from lifting to many people and working long hours. But we have no choice. We met in 2014 because i was volunteering in Africa teaching sign language to the deaf. I used the money I earned back here in the USA to support myself in Africa. I did this for the last 4 years. So not much of a savings when we decided to marry. So it’s been tough, but we are managing. But I can’t physically keep doing all these jobs, we really need him to work also!! Recently I had to resign from one, but my last day is may 10. We thought he would have his work permit by then. He has a job already lined up, actually he had the job lined up months ago. We tried expediting. The employer wanted to higher him before spring and is desperate. But for some reason when we tried expediting the card, we got no results. It was really strange. It’s like they lost our files because we kept calling for an answer and was told it’s approved and that someone higher then tier 2 would call us. But they never did and card never came. We went through this calling and same scenario for a couple months. Now we are finally into April and we saw they are finally doing November filers...so forget the expedite, we might as well wait for our turn. But sadly the employer waits desperately for husband to get the work card and now we also wait desperately because I had to resign from one of my jobs because can’t physically do it. Yea 😜 it’s crazy journey we all are on. It’s a waiting game just to live life.

Received a message on the phone, an email and the status already updated on the site. I'm elated! And still somehow in disbelief. It's that kind of long awaited thing that I hoped but didn't think would happen. 

 

Of course, we still need to be approved, but that depends entirely on us. Now it is all about waiting for the actual notification with the date and gathering all the necessary documents. 

 

Regarding EAD/AP, status is still at received and I guess it'll remain that way. 

 

I send everyone still waiting all the best vibes and a virtual hug. And some mental waves towards the USCIS, so they can work on those who've waited longer. 

@rrobin0609 & @JunkTardis , I'm certain you'll receive news very soon and we'll all celebrate and leave all this frustration behind.
