Hi

Can anyone give me some information on returning to the UK after AOS and Conditional Permanent Residency has been approved.

I own a successful Business here in the UK and will continue to work remotely once I (hopefully) move to the US. What I really need to know in advance is whether I will be free to commute to and from the UK once the K1 process is complete. I will most probably need to return to the UK every couple of months for say 10-14 days at a time.

Any help/advice would be appreciated.

I do know that once you have the greencard you can come and go as you please.

That's true, but one thing you have to remember is that you should find out when the time comes, because imigration laws are changing. Few years back, when I was a resident, I could go to my homecountry [Dominican Republic] and have a long stay (up to six months), now the longest stay a resident can do to DR is just 3 months.

I think every country could be different... so do your research on that, before making any plans that will put you in danger of loosing your resident status (hopefully) or make you violate the imigration laws.

luckily he only needs to be gone 10-14 days so i believe he should be ok.

Hi marianne_gc,

I can only give you advice based on my own experience, but I thought you might like to hear from me as I am from the UK too!

I moved here in last year on a K1 visa, and filed for AOS paperwork in Oct 2006 (as well as filing for EAD and AP) I received my EAD and AP in Jan 2007...I think that kind of wait is typical, but of course I could be wrong!

I used my AP as soon as I received it...I went back to the UK for a month - I had no problems re-entering (they did ask a lot of questions though) I am about to use my AP again, as I'm going back to the UK next week...so fingers crossed it all goes ok re-entering the US!! :-)

My greencard is also on its way (e-mail received) - so I would say from filing the AOS paperwork (coming in on a K1) it will have taken 8-9 months for the whole process...then I would say you'd be more free to come and go as you like...as I believe the AP does not guarantee you re-entry to the US.

Jan 24 - received AP

May 17 - received e-mail regarding greencard - IT'S ON ITS WAY!! :-)

That will cause no problems once you have your green card. Be aware however that longer stays (e.g. > 6 months) outside of the USA can cause your Green Card to be revoked so you are not entirely free to come and go as you please.

Also, it would be a good idea to avoid a trip home at the time you have applied for conditions-removal--until you have the 10-year GC in hand.
