Thanks. Your is around the corner. And everybody else is as well. Sad thing is when you get the approval, another process of waiting starts. It will come have faith.

So I just got my RFE notice in the mail. Apparently, the lawyer that I hired forgot to input question 4.a in regards to criminal record for the petitioner... again, please don't hire a lawyer for this. 

 

I don't have any record of criminal history, could there be a chance that I do have something that I just don't recall? I did have a speeding ticket a few years ago but it never went above $500. Or could this just be a simple mistake my lawyer made.

09/12/19: Sent AOS package

09/14/19: Package arrived at Chicago.

09/30/19: Received 3 text notification at 10 PM

09/30/19: NOA 1: I-765 'Case Was Received dated' 9/16 (checked status on USCIS site using receipt number)

09/30/19: NOA 1: I-131 'Case Was Received' dated' 9/16 (checked status on USCIS site using receipt number)

09/30/19: NOA 1: I-485 'Fingerprint Fee Was Received' and dated 9/27 (checked status on USCIS site using receipt number)

10/01/19: Check cashed after 12 AM (pending at current time of writing)

10/05/19: Received 3 NOA 1 letters (hard copy in mail)

10/25/19: Bio-metrics Appointment

11/12/19: Received RFE for spouse's birth certificate

11/29/19: Case Center received our RFE response letter and documents

12/20/19: Case is Ready to Be Scheduled for An Interview

01/10/20: Case is Interview Was Scheduled

01/17/20: Received interview letter in mail. Interview is scheduled on 02/14/2020 (Valentine's Day)

I would guess it's just a mistake. A speeding ticket doesn't count for what they ask about. So if you haven't done something bigger then the expensive lawyer simply screwed it.

 

I mean, if he would have put the effort in to check your criminal history ( what they don't) and found something bad he should have told you right? And he should have filed for a waiver. And I'm pretty sure you would remember  anything in your history that would need a waiver 😊

So apparently I had been mailed my NOA 2 on March 18, 2019 but the site and the app had not updated yet and I was just relying on these two for hopes until yesterday when my fiancée went into her mail box. I am so excited. 

Case filed : November 6, 2018

NOA 1: November 13, 2018

NOA 2: March 18, 2019

All November filers should be hopeful and please keep an eye on your mail box too because I almost missed because I was relying on app and the USCIS site.

They do go all the way back to your youth with the background check. They have access to "closed" or "sealed" cases so think hard about your past. There was a couple that had the same thing but he forgot about the case that he had as a teenager and it was sealed so he thought nothing of it. Said no to the RFE, RFE gets adjudicated and he gets a letter stating his case is denied because he didn't come forward with the court case in his youth. So, think really hard. If you have nothing, then you're fine.

@Quansah Congratulations. We received RFE on 15th March and they received it on 19th March. Hoping to hear an approval too.

To those who are wondering about the websites of USCIS. The first one to be updated for me was the "old site" the one that doesn't require the log in process. Today the new site updated as well. My experience was that both works... however it may be that it depends on the employee that is reviewing the case. I work in the government too and some co-worker don't update their cases online (because they don't feel like it). That said don't give up checking online and the mail box.  I hope everyone is having a great weekend.

Wow.. got it. Is there anyway I can pull these records of myself?? Or does it have to be all in memory.? I had petition my mother to become a Citizen as well and said no to criminal record but i guess thats a whole different situation.

I would take that post with a grain of salt..but if they give an RFE for criminal history..and there is something sealed...then answer the RFE truthfully.🤷🏾‍♀️

This RFE sounds like u forgot to mark the box. Nothing to worry about.

Thanks for the input Nina. I wont do anything to jeopardize our situation. Ive been thinking for a few hours and I do recall a red light camera ticket back in 2012, and it was a hefty fine in California. Only problem is I dont know if that ticket was above $500, I just know I payed above $300. Would it be okay to state it in writing? Or do i need to pull up a criminal record from somewhere?

So first..do u have a copy of the RFE and your app? Becsuse it sounds like you missed the box to check yes or no on 4a.
