I never received mine. Requested many times and ended up getting am infopass and a passport stamp bc I had to leave the country several times for work and leisure. Didn't have any issue, but if you don't need the letter I would just wait for the GC at this point.

Hey guys, quick question, does anyone have any experience changing jobs while I-751 is pending? I am pretty sure this should be a nonbrainner and no issues but wondering if anyone has an experience to share.

 

For the records I never got an extension letter but have a passport stamp and have been out of the country for work several times while my the approval is pending. I am just considering a job change and wondering if there's any implication on not having the approval yet. Any experience is appreciated.

You can definitely change jobs while it is pending since you have legal presence, as indicated by the passport stamp.  You may have to "educate" your HR staff as to what's going on--so it might be annoying, but is certainly doable.

Try getting a clean social security card based on the passport stamp from Social Security administration office. They make it in five days. If you have a clean social security card (without "DHS authorization" written on it)and a driver's license then that's considered sufficient proof of legal work authorization by the HR of any company.

I submitted my clean social security card and driver's license, but HR still requires me to submit my green card. They said they need to enter the A-number and the expiration date of green card.

I'd suggest contacting an immigration attorney to help you explain this matter to your HR. Because, what your HR is doing is illegal and you can technically report them for this. If they only need A# then you can provide it and expiry will be from the expiration of your stamp or receipt notice.

I second this. Clean SSN+Driver's License is perfectly legit. way to prove authorization.

Yes. So I started a new job here 3 weeks ago. My I-751 is still pending and I have the NOA together with my expired green card. HR asked for the letter (NOA), expired green card, social security card, and state ID in order to verify my employment status (I-9). HR contacted me later and asked me to call DHS as there was a TNC flagged due to picture thing. I called and everything was cleared during the phone call. Hope this is helpful.

Anyone in the EAC (Vermont Office) for ROC received their GC for November 2018 filers? My eligibility for N-400 is coming up next month and I'm trying to make a decision if I want to file for citizenship while pending ROC.

There's a difference of opinion on this site, but I would say it's leaning towards filing for citizenship when eligible.  Unless you really want a 10 year green card first, it might only slow the process down a bit, or in some cases might speed it up.  For us, citizenship is our final objective, so we plan to file when eligible and will use GC+extension letter or passport stamp in the meantime.

I used Rapidvisa to prepare my ROC.

 

When I read that people where asking about starting their N-400 process while waiting for the ROC to be processed, I reached out to them to ask if this was possible. They mentioned that USCIS will only process one petition at a time. So they suggested I wait until getting the green card before submitting the N-400 petition.

 

I searched online at the USCIS website, looked at their Manual of Immigration Policies and found on the chapter of Conditional Permanent Resident Spouses and Naturalization this:

For what I can understand it says that you must have your ROC approved before they approve your N-400. What is not so clear to me is if there is any gain or issues in submitting your N-400 petition while still waiting for the ROC to be approved.

 

In my case I have a stamp in my passport that I need to renew by the end of the year, and they took my green card during that process. So I only have the stamp and the copy of my extension letter that arrived after I got the stamp.

 

I am also aiming for the citizenship but don't want to risk making this process more complicated then necessary. Ever since My husband filed my K-1 Visa petition this has been a long path that has taught me how to manage my patience (and it has not been easy!).  At this point I wonder if I would rather wait to get the GC before starting the N-400 if there is no gain in doing it before my ROC is approved.

 

So my question to everyone is:

Is their any gain in starting the N-400 while waiting for approval of the ROC?

One interesting bit I read in the field manual that might contribute to slowness is:

"In almost all cases, a Form N-400 that is filed while a Form I-751 is pending will have been filed pursuant to section 319(a) or 319(b) of the Act. These provisions require a higher level of evidence of marital union and joint residence than is required for the approval of Form I-751 filed jointly." from https://www.uscis.gov/sites/default/files/USCIS/Laws and Regulations/Memoranda/cond_perm_resident_.pdf

I think more it’s a persona decision I prefer to wait for my GC to be approved for the 751 just because it may slow down the process. LIN Filers are moving the fastest as I can see and I am also LIN so I’m hoping to hear word soon then I file for N400.
