01 November: Package received

08 November: Check cashed

01 December: Green card expires

mine finished on 11/18/18 and sadly did not receive it,

I spoke to some people who did the ROC earlier months and some only took 2 weeks the most  so I aint sure why us November filers are taking the longest to get them.

 

lets hope to hear some good news soon.

Thank you!  I called USCIS this morning. The rep who answered said she couldn’t supply me with a receipt number but she did create a service request on my behalf. She said I should hear some kind of update in a few days, so I will keep everyone posted. But she did reassure me that my status was okay and I didn’t have anything to worry about. Should I need to travel I could obtain a stamp from my local office for my passport, but I have no plans for travel so I’ll just sit tight until I hear some good news. Neither do I have an employer to worry about so my sympathies to those who do. This is quite the wait. And this is just for the extension letter!!

I wonder if we have to have a appointment for the stamp or if we can just go in to get it,

A little update on our case, I called the USCIS customer rep this morning and she was able to provide me with our receipt number, which starts with LIN. She also told me that USCIS mailed me both my NOA1 and biometric letter on November 9. I have not received anything and there’s no other reason besides they’re lost if they actually mailed me both notices on that day. She said it’s fine if I don’t receive my NOA1 after 30 days but call them back if I still didn’t receive my biometric letter after 30 days.

Just want to get a clarification- if they have cashed our check- that means our case has been opened with receipt number- which automatically grant us the 18 months extension right?

They have been telling everyone that they mailed, which in fact they only issued the letters, but they did not send them out. Welcome to the LIN Frustration Club, where the stress is a a premium feature!

Correct, if the cashed the check a receipt number has been issued and the case was accepted and routed to a service center.

Update: I talked a representative at USCIS. She informed me that our application was received on 11/20 but they haven't issues an i797 yet. She said that i797 provides automatic 18 months extension so sometimes they do not issue it right away and I should check back in a week.

 

However, she did provide me with a recipt number starting with SRC. This is really confusing. How is it possible that she provided me with a recipt number but i797 hasn't been issued yet?

 

Does this mean that my wife doesn't have an extension until we receive i797 aka NOA in our hand? 

 

Can someone help me understand this please?

Your file was received and accepted and your wife was granted with a 18 months extension on her residency. 

Until you receive the NOA1, this 18 month extension is only available to USCIS,  but still legally true for your wife even if she can't prove it with a document. 

Having a receipt number helps to reassure applicants that they are in the USCIS system and they are "safe" while their cases are being processed.

For divorce cases,  it depends on each case.  Applicants being divorced have to prove that they entered in marriage with good faith. There is a lot of divorce cases that go very well and are processed in the same time frame than a joint application. 

Most divorced i751 that take longer are when there are suspicions about the truthfulness of marriage, lack of evidence over the 2 years of marriage,  divorce not finalized because the other partner is making it hard or the judgment isn't available yet... and some lawyers want to use more than one category ( divorce and violence) and they have to gather more proofs. 

 

If your divorce is finalized, you have your final judgment issued,  your evidences of true marriage or of  being battered...etc, the time frame would be the same as other applicants. You will show up without your ex and confidently defend your case like your life depends on it.

 

This backlog we are experiencing is common to ALL applicants.

I forgot . Always Make sure your lawyer is on time with any update on your application. Lawyers are so busy, they tend to be slow to react to a notification. 

If he/she didn't put a 1145g notification form,  monitor that your money order has been transferred AND received by the uscis. Then YOU call the USCIS to get your receipt number.

 

But anyway,  always call the uscis to make sure that your lawyer is doing a good job, your file is being processed and you have at least the 18 month extension in their system even if you don't receive the NOA1 yet. That will give you a little rest while waiting.

From reading ROC threads from the previous months, it looks like the process has been getting slower.  If you poke around the October thread, there's a good number of people who have yet to receive their NOA's.  It also seems like when they tell people the date they issued the NOA, that seems to be an imaginary date with no correlation to physically mailing the NOA out.  I'm guessing it's going to be 4-6 weeks for us November folks.

Thanks for the information. I really hope they can issue the NOA1 for us soon. I just checked the processing time for Nebraska Service Center and it's showing 19-20 months....
