How many days did it take to receive the notification of case transfer to NBC after filing the N-400 or maybe after you had your N-400 biometric appointment?

N400 biometrics was done 12272019. The transfer notice updated on the website 01212020. So 26 days..

We received a notification tonight that we have also been transferred to another service center(from California). We did not file for n400 yet...although we are talking about it. Happy to see movement and glad to see others are having activity with their cases.

Hey guys, we got an RFE from USCIS saying that we filed late and must provide a reason for late filing. My conditional card expired on January 10, 2019, and they received our I-751 on November 06, 2018. 
 

We did get our NOA very late, in February 2019, but the receipt date was still correct.
 

This means we filed within the 90-day window, right? I just want to make sure I am not crazy 😕

01-16-2016: AOS package sent

01-09-2017: AOS (I-130 and I-485) granted

10-31-2018: I-751 filed

01-25-2019 NOA received (Extension letter, Biometrics waiver letter)

10-19-2019 Biometrics letter received

10-30-2019 Biometrics to be completed

Wow, that is really strange... According to the USCIS website it states: “

  • NOTE: You must file your petition during the 90-day period immediately before your conditional residence expires if you are filing Form I-751 jointly with your U.S. citizen or lawful permanent resident spouse.” 

It seems like you did submit your application on time. We are also waiting for an RFE, according to the USPS app, it’s going to arrive today...

 

Did you submit your application with a lawyer? I would make copies of your GC, your NOA, the information available online, you may also find the “Period for filing petition”  online under “Title 8, chapter 12, subchapter II, Part II/ 1186 a” .

 

Explain in a letter that you filed during the 90-day period before the second anniversary of the alien’s obtaining the status of lawful adminission to PR. If you can afford it and you want,  maybe you can have a lawyer go over all these documents before you send your evidence back to them. Maybe you can contact USCIS over the phone next week as well to explain to them that it is an error, and you filed on time. Has anyone been in this situation before? 

 

I am really sorry. Hopefully, our RFE arrives soon...

Thank you so much for your response! We do not have a lawyer. Do you think it’s worth getting one now? Also yes - please keep us updated what you get in your RFE!


We were going to send 

1) the NOA receipt of I-751 showing receipt as of 11/02/2018 (it was issued to us really late, March 8, 2019 - maybe hence the confusion?) 

2) Copy of conditional greencard showing issuance date of Jan 2017 and expiration date of Jan 2019

3) The 120-day notice from September 2018 saying that I should submit I-751 within the 90-day window.

 

This is really stressful, it just makes no sense why after 15 months of waiting, the officers are issuing an RFE based on misread dates...

Hello,

 

We received our RFE. They are requesting documents that we have previously sent. The only documents they are claiming that we actually did not send are joint bank statements for 2019 and joint tax returns for 2018. We filed on November, 2018, therefore, these documents did not exist then...They are not acknowledging the vast amount of evidence that we initially sent, and according to them, we did not send health, joint home, and auto insurance. We sent all this information and we even provided a very detailed index to be as specific as possible.  Our package weighted 6.2 lbs, and according to them, we only sent: join bank statements for 2017, 2018; join credit cards; photos; and joint tax returns dated 2016, 2017... As you can imagine, this is pretty discouraging. We are going to submit further evidence with a lawyer.

 

The letter does not specify which additional documents they require. We assume these are the ones  that they said they did not receive. They only give you a long list of evidence that you can send...We will see how our lawyer wants us to proceed.

 

As always, any help or suggestions are always welcomed.

Yes, you should definitely send that information and probably a letter explaining to them that you did actually submit your application on time.  I am not sure if for your case it is worth it or not to hire a lawyer. It is up to you, probably not necessary. In our case, we are doing so because they are not acknowledging all the evidence that we already sent (bills, affidavits, house deed, retirement plan, etc.), and they wanted us to send documents that back then did not exist...You cannot have bank statements or tax returns for future years...We will send to them whatever our lawyer tells us to since they just state to submit additional evidence.

 

I totally understand your stress...We feel the same way. We work and have other responsibilities just like you all do...

Yeah looking at case tracker, there are very very very few approved so far. I guess I got lucky and I was not expecting it at all yet! Hoping you get yours soon too!

having a lawyer wouldn't change anything. Just follow the instructions they sent you. They basically want updated evidence, which happens. So, all you have to do is send all the evidence you accumulated after 2018. 

 

I am not sure why you feel discouraged? You should be happy as now you know they are looking at your case, and if you send them what they asked for, they will approve you probably within 90 days without an interview
