My 2018 tax return income will not meet the poverty guideline but my current income for 2019 is going to be higher because of increase of pay rate. I am just waiting for approval right now. In affidavit form I saw there are two  income requirement one is current income and one is tax return income for last year, this is so confusing.

It is 100% poverty level minimum for fiancee visa and 125% poverty level minimum for AOS and spousal visa.  It is all based on current income.

PHILIPPINES ONLY!!!  CFO (Commission on Filipinos Overseas) INFO - Can't leave home without it!

PDOS (Pre-Departure Registration and Orientation Seminar) is for ages 20-59.  Peer Counseling is for 13-19 years of age.

It is required to have the visa in their passport for PDOS and Peer Counseling.

GCP (Guidance and Counseling Program) is for K-1 Fiancee and IR/CR-1 spouse ONLY.

Very hard to meet the assests section /  if most can not meet the poverty guidelines,  it would be highly inprobable that they meet the assests / it is actual cash value of all and value (minus morgage for a property) must be proven

Financial sponsors can only include assets that are convertible into cash within one year and without considerable hardship or financial loss to the sponsor and his/her family. Examples of assets easily convertible to cash are savings, stocks, bonds and property. Sponsors may include the value of their home. They may not include the value of their automobile, unless they can show they have more than one and the primary automobile is not included as an asset.

Sponsors of spouses and children of U.S. citizens must only prove assets valued at three times the difference between the poverty guidelines and actual household income.

from the same US immigration site listed below

they can accept the new if CO is willing

the Form I-864 remains valid indefinitely unless evidence of failure to meet the poverty guidelines in effect on the date of I-864 filing arises. The consular officer will determine whether the income claimed by the sponsor and documented with financial evidence meets the poverty guidelines in effect at the time the I-864 was filed. If the income claimed does not meet the poverty guidelines, then the consular officer may request that the sponsor submit current year income information.

this is from US immigraton site

@adil-rafa thanks for the info🙏🏾

I did that with my assets and times by 5 if needed and we’re still over the requirements...

I’m just concerned if they won’t even consider it... with that being said, are assets to meet requirements not as efficient as joint sponsor?

(as I’m being hopeful they do... )

I live in the states alone with my children didn’t want to approach another person to add as joint sponsor if my assets would meet the requirements

I submitted taxes for 2015 met requirement, 2016 met requirement, 2017 did not meet requirement. I submitted pay stubs from May 2017 to present and employer letter with actual Salary above requirement. On I-864 I put income from employmer letter.

The good news is that they kept your spouse's passport; They intend to stamp a visa.

Logically, your 2018 Taxes should solve it for you. I believe you can file as early as mid January.

It would have been ideal to have your spouse join you now, but look at the bright side here;

No refusal and they kept his passport. Only a question of time.

Yes definitely thankful for the outcome. I'm confident on my 2018 income just wanted to make sure I'm able to resubmit evidence for myself. 😊

@Josie333 When you sent documents did they accept the documents as last year income did not met but current income is met ?

No, they only looked at 2017 Income Tax Return and Transcripts. The CO said their system only accepts 2017 taxes, doesn't consider any other evidence. Therefore income was not met.

In short, even if I meet income for the past 6 months or past year it doesn't count. It must be on tax form. This is Casablanca consulate so your country may be different.

*Also note that NVC accepted the evidence however the consulate did not. *

I don t see why not. One would think and believe the Consulate would rather see you as the sole sponsor.

If anything it should be a stronger addition to your case and he should get that Visa pronto;

November and December fly thru due to the many holidays … Congats :)

She is right

Casa only looks at the most recent tax returns

Employment letters are not considered (for the current year) as they feel a person can leave that job at any time and not work the year out /therefore not have the income stated

they have also denied a person who met the 125% but had 2 part time jobs the theroy behind that decision was the USC would quit one to spend time with the husband and both would become a government liability / never thinking the  beneficary would work

NJ & RJ - Be cautious about relying on assets. We went through CDJ, and they would not even consider assets at my husband's interview. I don't work so I have no income, but we have way beyond the asset requirement. Our lawyer had warned us to have a joint sponsor lined up just in case, so everything went fine. I don't know anything about Haiti specifically. If you haven't already, I would discuss with someone very familiar with what they do and don't accept at the Haiti office.

Best of luck to you and your family....

I have heard that need to provide copies of pay stubs for six months  and letter of employment for current income

At our interview last week my I864 was ripped in half.   They gave me back all my transcripts, pay stubs and employer letter.  They only kept the form.

They had no issues or questions on it either.

Ours did and it is possible.

Unfortunately OP needs the W2’s and tax returns to go with the bank and income statements (or) a joint sponsor.

Seems to be aggravatingly country specific.

@OP you won’t have a transcript for a couple of weeks after you file however in the past printed tax returns have been accepted if you include the 1099’s / W2 etc attachments that formed the basis of the return.  Good luck.

Is your last year income was met on the tax return ? if not, did they asked any thing regarding the joint  sponsor something? We have the same embassy Islamabad.
