K1 Visa Packet Concern

Hello everyone. Me and fiance are currently waiting for our NOA2, we received our NOA1 on August 3, 2018. So we were having a conversation about something which led to his Violation 7 years ago, he’s currently 27 years old. He said that he was parking on a certain spot and he accidentally hit a car behind which caused a small damage to the car. He said that he got scared and drive off. Later on, a police officer called his family regarding the incident, they reached the court but paid only for the fine.

 

He completely forgot about that and we are a little bit worried now because we forgot to include in the packet regarding the violation. Would we get an RFE? Would it be a problem?

What was he charged with?  Leaving the scene of an accident?  or was he simply issued a citation?

He left the scene but there was a camera that he was the one driving. They were in parking spot and when he was trying to park he accidentally hit the car behind which leave a small dent to the car. Nobody was in there

It's too late to correct the issue.  I would definitely gather all the documents now in preparation of a possible RFE.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I asked him and he said he simply had a citation and paid the fine

Thank you. I did read the part of Criminal History on the K1 packet and it says there Citation, Arrests, EXCLUDING TRAFFIC VIOLATIONS unless it’s drug or alcohol related or paid 500 usd fine. And he simply had a traffic misdemeanor..

Hit and run on unattended vehicle. Since he was at the parking lot that left small scratch on the other car

Filed everything ourselves with no RFE's or delays.

 

CR1 for Child under 21 (20 at time of filing)- Filed by LPR Spouse for his son

4/12/20   NOA1 rec'd

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

10/14/21 Mailed to AZ PO Box. Let the waiting begin. Again.

If you weren’t convicted an arrest during that time, you should be fine. Did they did any fingerprint for your husband? If the answer is no, like I said your fine. Just in case, bring certified copies of the disposition result and full details of the police report. To viod any RFE...
