What if Employer doesn't accept i-751 extension letter and denies to hire me

Oh I see the goalposts have moved. Glad we established that my original claim of "terminating/ not hiring someone because you don't like the valid documents provided during the I-9 check is illegal and falls under employment discrimination due to national origin" wasn't "nonsense", though.

 

As for proving it  well that would be exactly why I advised asking for it in writing (reading helps!) and barring that, well lots of people file suit and win employment discrimination cases with far less. The circumstances here would be fairly straightforward-- he has the job and is concerned about being terminated during the I-9 process. They would be telling him why, effectively.  Harder to prove would be if the refused to hire him well before this juncture, but that's not the topic because that's not the situation here. But that wasn't your initial criticism anyway. Glad you learned something today.

23 Jan 2016: "Blizzard of the Century", wedding canceled/rescheduled (thank goodness we were legally married first or we'd have had a big problem!) :sleepy:

24 Jan 2016: Small "civil ceremony" with friends and family who were snowed in with us. December was a bit of a secret and people had traveled internationally and knew we *had* to get married that weekend, and our December legal marriage was nothing but signing a piece of paper at our priest's kitchen table, without any sort of vows etc so this was actually a very special (if not legally significant) day. (L)

16 Apr 2016: Filed for AOS and EAD/AP (We delayed a bit-- no big rush, enjoying the USCIS break)

23 Apr 2016: Wedding! Finally! :luv:

27 Apr 2016: Electronic NOA1 for all 3 :dancing:
29 Apr 2016: NOA1 Hardcopy for all 3
29 Jul 2016: Online service request for late EAD (Day 104)
29 Jul 2016: EAD/AP Approved ~3 hours after online service request
04 Aug 2016: RFE for Green Card (requested medicals/ vaccination record. They already have it). :ranting:
05 Aug 2016: EAD/AP Combo Card arrived! (Day 111)
08 Aug 2016: Congressional constituent request to get guidance on the RFE. Hoping they see they have the form and approve!

K-1 Visa Timeline:

PLEASE NOTE. This timeline was during the period of time when TSC was working on I-129fs and had a huge backlog. The average processing time was 210+ days. This is in no way predictive of your own timeline if you filed during or after April 2015, unless CSC develops a backlog. A backlog is anything above the 5-month goal time listed on USCIS's site

14 Feb 2015: Mailed I-129f to Dallas Lockbox. (L) (Most expensive Valentine's card I've ever sent!)

17 Feb 2015: NOA1 "Received Date"
19 Feb 2015: NOA1 Notice Date
08 Aug 2015: NOA2 email! :luv: (173 days from NOA1)

17 Aug 2015: Sent to NVC

?? Aug 2015: Arrived at NVC

25 Aug 2015: NVC Case # Assigned

31 Aug 2015: Left NVC for Consulate in San Jose

09 Sep 2015: Consulate received :dancing: (32 days from NOA2)

11 Sep 2015: Packet 3 emailed from embassy to me, the petitioner (34 days from NOA2).

18 Sep 2015: Medicals complete

21 Sep 2015: Packet 3 complete, my boss puts a temporary moratorium on all time off due to work emergency :clock:

02 Oct 2015: Work emergency clears up, interview scheduled (soonest available was 5 business days away--Columbus Day was in there)

13 Oct 2015: Interview

13 Oct 2015: VISA APPROVED :thumbs: (236 days from NOA1)

19 Oct 2015: Visa-in-hand

24 Oct 2015: POE !

15 Dec 2015: Fiance's mother's B-2 visa interview: APPROVED! So happy she will be at the wedding! :thumbs:

3 or 4 different people have said that the letter extends the expiration date of your green card (#2 of column A). It more or less IS #2.

 

This is exactly the reason why 3 or 4 people have said that it would be best if you got an unrestricted social security card (#1 in column C) so that you can just bring that plus your drivers liscence (#1 in column B) and  ot have to worry about green card expiration dates.  But because you dont have time for that, your green card plus letter is sufficient and they legally cannot reject it. It is just easier because as you have noticed, the extension letter isn't explicitly listed and that could confuse people who don't know what they are doing. However, there is a 0% chance that this large company has not seen an extension letter before. They will know how to handle this.

I found this info saying that it's List C.... I gotta show them what is what. HR manager doesn't know what kinda document is i751 extension..

The extension letter + green card makes the green card still valid. A green card is on list A.

The item you noted in list C is for an EAD. Green card holders do not use an EAD.

A Form I-797 issued to a conditional resident may be an acceptable List C document in combination with his or her expired Form I-551.

Form I-797 is an approval notice.

The extension letter should be an I-797C.

Yeah.. I know I is a class C prove but how are they supposed to put it on the system? Look at page 2 of i9 there is only one space for one document

Update... even though I explained it to them they had no idea and sent documents to corporate office. Corporate office didn't answer whole day. Will go back tomorrow... I'm so tired guys.. I can't take it anymore.. I quit my job to get this one now I'm gonna loose both

Please read it again- the EXPIRED GC is NOT considered a List A document because it is EXPIRED

 

You can use an expired GC + 797 extension letter as a list C document. So 2 things, card+extension letter = Item C requirement.

 

Save the picture and send it to HR/corporate if they have an issue.

 

You also have to come up with a list B item and it can not be your SS card since it says not valid for work.

 

Also are you trying to change your name with SS card (using married name now or going back to maiden) if so that is why SSA cant issue you a new card in the new name. If you are NOT changing your name you should be able to get an unrestricted card from SSA.

Well they didn't even run e-verify.. I tried to explain to the HR they said since they've never seen such a thing they have to talk to corporate office about it..
