I just want to ask those people who applied for EAD online. I just applied online for my EAD, for my AOS I alread have my biometrics appointment on May 30th but I requested an earlier interview next week. My situation is I accepted a job already and theywant me to start this Monday. they didn't even care to look at my social security card or whatever papers I have, they just hired me. For my part, I want to apply for working permit just in case my green card will be delayed for som reasons. I knw that I have 3 days toshow them the receipt which I have already now because I filed online and then I have t show them my working permit within 90 Days.

You need the EAD to start work not the reciept.... to complete the I-9 when you start work you have to show your EAD or Greencard.... a receipt is not one of the listed acceptable documents..... it only shows you have filed for an EAD it does not you have been approved.... until approval you are not Employment authorized....

I read the instruction about the required docs, but I believe you are wrong when you say EAD is a must to start to work.. It says that I can show the receipt that I have applied for the permit and I have 90 days to show that to them. Either way, thank you for your reply but I am asking for those people who E-filed and howlong they received their card.

Oh and by the way Im also here in Boston..;-)

Elizbeth..... you are not employment autorized until the EAD application is approved.... the wording you are looking at is for people who are renewing an existing EAD... they only have to show that they have filed for it.... for the initial EAD you need approval first....

Can I fire an employee who fails to produce the required document(s) within three (3) business days?

Yes. You can terminate an employee who fails to produce the required document(s), or a receipt for a replacement document(s) (in the case of lost, stolen or destroyed documents), within three (3) business days of the date employment begins. However, you must apply these practices uniformly to all employees. If an employee has presented a receipt for a replacement document(s), he or she must produce the actual document(s) within 90 days of the date employment begins.

Kez, you need to read that line quote again. You can only show receipt "in the case of lost, stolen or destroyed documents". You need an approved EAD renewal to continue work otherwise, you can't simply apply for an EAD when your previous one runs out and use the NOA as prove you are legal to work because you are not. It is pretty dangerous IMHO to suggest that this is the case on a forum such as this.

From the receipt rule post from meauxa:

If an individual’s document has been lost, stolen, or damaged, then he/she can present a receipt for the application for a

replacement document. The replacement document needs to be presented to the employer within 90 days of the date of hire or, in

the case of reverification, the date employment authorization expires.

ok so Please replace the word renew with replace.... does not change the fact that a reciept is not enough to be able to work....

No, but renew and replace are very different things! The important thing is having approved EA, not the card itself or a receipt.

Ok so please ignore anything I have posted in this thread.... if you can find an employer to employ you without an EAD then good luck.... I am sick of people saying yeh all you need is EA not the card.... well without the card you have no way to prove you are EA... but hey I think its time for me to bow out of VJ I am getting very tired of the people who take great delight in correcting other and picking people up on a technicality.... the op was thinking they could start employment with just a reciept I tried to point out that this thinking was a mistake.... so I am not good at puting thing over.... I did include a quote and the OP could read forthemself if I caused confusion....

Must be so good to be able to go around picking people up.... thanks for your time...

To the OP Unauthorized work is forgiven if you are married to a USC so if the employer is willing for you to start then dont wait for the EAD.... it would be them and not you that would get into trouble....

I agree with you on this, only needing the EA is technically correct, but most employers will demand to see the card itself. However some employers will accept this, my own included, who were able to verify my EA by taking my NOA1, typing in the receipt number into the USCIS website, and seeing that my EA was approved. Most employers however are not this smart or resourceful.

I'm sorry if you feel I was being picky, my main point was really to correct your statement about renewing the EAD and only needing to show receipt, which was wrong. I'm sure you'll agree with me

that it is in the best interests of this forum to correct misleading information which could lead to people losing their jobs.

Hi Elizabeth,

I live in th Boston area too. I think your EAD should be approved within 80 days, if you need it ASAP, you might want to contact your congressional office to see if they can help with speeding up the approval.

If you're still within your 90 days and your I-94 is still valid then you should allowed to work until that expires.

Out of curiosity, does the system charge you more to E-file that form? I think I want to E-file for my husband's EAD but if it charges a higher rate I may just mail it in.

Also, is it supposed to be faster to get the EAD if you E-file?

Its not quicker to e-file and it doesn't cost any more or less. IMHO there's little benefit to e-filing as you still have to mail in the evidence for the I-765 (photos etc), so you might as well just mail in the form as well.
