Of course on the message from NVC on the CEAC website does not state why and since it was a Friday after 5 I was not able to get through to my laywer. I decided to call NVC myself and spent 1 hr and 30 minutes just to be able to speak with some one and they told me the issuing authority was incorrect on the police certificate. Now I’m pretty sure we had the correct one but since I didn’t have the original in front of me because I was on my home from work I didn’t argue or dispute it. Once I get home and look at the certificate it says word for word what NVC was looking for. I call back and wait almost 2 hours on hold and told them and they finally just told me I can go in and look at the file uploaded to make sure and when I go in to see the laywer uploaded the receipt of the certificate not the actual certificate!! At this point I am livid and decided just to upload the correct document myself. So that’s done and then today about 9pm I get an email regarding my stepsons case. When I go in to read the message it says that his birth certificate is not in an upright position and must be corrected for them to accept it🤦‍♂️🤦‍♂️... Yet again another small stupid mistake that the laywer made just delaying the process even longer. Mind you it’s been almost a whole year and we still haven’t been able to complete this process. On top of all that my wife broke some terrible news to me yesterday that she had a miscarriage. She was only 17 days pregnant but we have been trying for so long ever since we have been married. It is just so upsetting and frustrating with everything else going on.. We have been married for 2 years and I have only been able to be with her for a total of 4-6 weeks since we’ve been married. It just feels like all hope is being lost and we really are just drained. I’m sorry for such a long post but I just needed to vent out to people or someone who are in a similar situation. It is not easy being away from your partner for months and months at a time and when we see each other it’s only for 2 weeks due to my job.

In 5 Days it will be 1 year since they received our case... A year ago we were expecting us to be on the NVC phase atleast around June/July.. That its soon October and seeing other centers having people from January-March 2019 getting to the NVC phase is ridiculous and almost unacceptable, even some people from Nebraska center that got their NOA in November-January getting accepted??... Is there any point trying to call them? Ask them to transfer or something? Tell them to hurry up for sake...

 

Checking the processing time here and on the USCIS website is confusing as it says so different. Here on VisaJourney it's on petitioners around 3th September. Going to the USCIS site it's on 31st May 2018.... Have they shut down completely or what is actually happening?

I agree with you but I am always told that it should come as a approval this month or next so if anything passed a year that we should give that a inquiry soon! Even if you call USCIS now, they will tell you it’s still processing so it’s no use I think! I’ve been waiting almost a year as well so i guess we should wait til it becomes exact a year of applying for i130! Nabraska is pretty slow but hopefully it’s our (October 2018) turn next for this month and next! The tough part has gone by fast so we don’t have lots to go on with this approval hang in there...good luck!

Sorry to hear about your problems. And you are in Perth, right? I am surprised your lawyer has made so many mistakes. My lawyer for my wife's visa is in Texas and I too had some trouble at first even though I sent her a completed I-130 I had filled in before contracting her. She or her assistant never looked at the I-130, there were so many errors on the one they sent me to sign. My wife and I live in Brazil so I hired a Houston immigration lawyer where my cousin's daughter works... It took months to get a decent I-130 out of them and all the necessary documents together. We hope soon to receive NOA2 approval.  Good luck!

Thanks. No I live in Perth Amboy in NJ. It feels like no laywer is competent enough to do the job. Honestly now that I see what has to be done with this while vida process I feel like I could have done everything on my own and I wouldn’t have any of these issues. The only reason a I hired a laywer was because I was afraid of committing any mistakes since I’ve never deal with anything like this before.

This our second visa. My wife spent too much time outside the USA due to family medical situations (mine included) and as I was not aware of how hard it is to acquire a new visa so we are in this nightmarish scenario. So like you I was afraid of making some mistake delaying our return so I hired a lawyer. We have to see if the NOA2 is approved before I can say it was a good idea. Our priority date is Oct. 25, 2018 and our service center is Nebraska - the slowest.

I think we’re all frustrated at this point... and scared of making mistakes... we didn’t get a lawyer and I’m terrified that after waiting almost a year they will come back with an RFE or something else to further slow the process.. 

 

hubby reckons he’ll explode if they ask for more info after waiting in line so long... but what can you do... it’s all part of the terrible process.. that continually gets stretched out... 16mths now I think it is, with yet again may 2018 as the date... 

 

how many times cant they process may? I think it’s been pushed back to there 6 times at least in the last 9 months.... it was May when we applied ffs. 

 

fingers crossed we we all hear good news very very soon

Funny, I was just thinking it ought to be time for them to roll back the dates again. We can't seem to get past May at Nebraska.

 

We hired a lawyer in the US for I-130 to try and avoid mistakes and thinking it would help. Same situation, neither the clerk or the lawyer even read it over before sending it to us to sign. In correcting everything I could have just filled the form in myself and saved the money. It has been 353 days on our I-130 and we are still waiting. I'm terrified they messed something else up and after all this time we will get an RFE or worse. They sent it in and have washed their hands of it just blaming the administration. Apparently that excuse means they don't even have to follow up and just direct me to the website now.

 

Loads of questions I had they didn't answer so I was forced to research online anyway. Luckily, that led me to this site! They messed up in telling me things I did need and caused me a great deal of grief, however, I am now prepared for the next phase on my own. If all goes well I don't think I will be using them since they want double what I paid for the I-130 to complete my case.

 

Assuming our case ever gets approved that is...

That is my fear as well although my case is at NVC already but I feel it’s taking a little to long to get our interview date and I’m afraid my lawyer made another mistake somewhere down the line. They are doing the same thing as yours blaming the system and administration for there mistakes which frustrates me even more. If a mistake was made at least own up to it and apologize it’s peoples lives they are messing with. I am going to attempt to finish off the rest of this process on my own as well I am fed up with having to deal with there mistakes.

That looks like a proper way of cheating your way forward.. when other people have been and are still waiting for a year now. And see other people getting the I-130 approved in 4 months. Such a corrupt system...

honestly I’ve been almost waiting for a year as well! I’ve heared of this too so yes I am a little confused.... hopefully we get our approvals this month let’s keep praying 🙏🏻

The question is then if it’s actually this corrupted then should we try aswell? 

 

I’m hoping it will get approved in a week or so “naturally”, but to be honest I have not faith in this system anymore. I’m afraid it’s not gonna be approved until next year or soemthing

I first heard about it on the Nebraska I-130 message board due to the lengthy time that service centre takes to process applications.

 

The I-129F was meant to be for families in situations like ours to allow the family to be together while waiting for the I-130 to be approved. It is supposed to add steps to your case and they don't really issue the K3 visas anymore but it is still a valid form and path to apply for. Based on the other posts, members discovered if you file for the I-129F then USCIS will pull your I-130 and approve it within 3 weeks-80 days of submission. Then they deny the I-129F application. I can confirm this worked in my case.

 

Due to the length of time that passed already we debated whether we should file the I-129F or not. We decided to go ahead as more of an insurance policy in case Nebraska pushed out timing yet again. I do believe filing the I-129F helped our case get approved faster but there is a possibility our number just came up.

 

There is a lot of information on the I-130 Nebraska message board on the subject and instructions on how to complete it on this forum which I followed. It is super easy to file for and doesn't cost anything but your time and the postage. I wish I wasn't hesitant and just applied for it sooner. I would be further along today if I had.
