Second (!) RFE!

Hi everyone.

 

After eight months of waiting I was disappointed to receive an RFE requiring more proof of my relationship with my fiance (we both live in Japan and have been together for about 3 years, I am a long term resident looking to come back home). I sent back a packet of proof I compiled, again hopeful that this would get us to the NOA2 stage.

 

Unfortunately I got back another RFE, this time because I "submitted no proof of US citizenship". This is actually false because I included an original (not copy) birth certificate in my original filing. I knew that this would not be returned to me, but my parents had an extra one so it was fine.

 

The RFE makes no mention that it was submitted in the original filing, whereas my first RFE said what I had submitted was not dated and not sufficient proof. In the RFE letter it says that they want "a birth certificate registered and issues by a civil authority that shows birth in the United States. The birth certificate should contain the child's name, date and place of birth, and parents names, doctor's name, hospital name ... etc.

 

After reviewing the photocopy of my birth certificate it does not contain doctor or hospital information--but after checking online I don't see any example of Minnesota birth certificates including that information. Did they lose my cert or was it rejected because it wasn't enough?

 

I have two options

  • Resubmit same birth certificate, this time just a photocopy of front/back (back is blank)
  • Submit passport copy; this is problematic however because I have a new 90 page passport and I believe you have to copy EVERY. SINGLE. PAGE. which seems like a waste of time and money. Am I wrong about this? Is it enough to just photocopy front page?

 

Likely I will submit both, but not if I have to copy every page of my mostly blank passport. Please advise VJ family :(

often happens (since we are told not to staple, etc)that a document is misplaced by USCIS

they had an original of my marriage certificate and at NVC stage wanted it again

make sure it is labeled with your case number,  both names and both DOB's even though u send in the cover letter from them

USCIS misplaces things all the time. The simplest is a copy of the bio pages from your passport, should have just done that to begin with.

12/06/2017 - I-485 Approved

I would send them the copy of the birth certificate and all THE pages of the passport. I had all the pages of now my husband passport. yes, seems like a waste of money, but better give them EVERYTHING instead of getting another ref or rejection.

I had three photos when I sent it in (and a fourth which had the date, but it fell out of the 2 year period). But I didn't write the date or location on the back. When I sent in the RFE materials I wrote location and also an explanation of each regarding where it was taken, etc. I also included copies of chats with family members and friends that talked about physically meeting my fiance (such as what we did to celebrate Christmas, birthdays). Also included copy of my Japanese residence card to prove my residence here.

 

Thank you for the quick replies... looks like I have a long time at the convenience store copy machine to look forward to 😛 Really hoping we can wrap this up by Dec 31st because if I'm here Jan 1 I have to pay Japanese taxes...

Just to clarify....are you sure they asked for proof of relationship in the RFE? I ask because this is not a requirement of the I-129F (they determine if the relationship is bona fide at the interview). They likely asked for evidence of meeting within the past 2 years and/or letters of intent to marry.
