I had a co sponsor nightmare at the embassy stage.  I am getting ready to prepare my husband's AOS packet and will attempt to file the I864 based on my own merits.  My current income exceeds the USCIS 125% guidelines.  I will be filing I765 along with the I485 so my question is at what stage are RFE's issued?  Will my husband receive his employment authorization or will the RFE for the co sponsor (if needed) come first?

Generally think RFE's will come first. EAD/AP is still taking 4-6 months right now to receive.

08/15/2014 : Met Online

06/30/2016 : I-129F Packet Sent

11/08/2016 : Interview - APPROVED!

11/23/2016 : POE - Dallas, Texas

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

If there is an RFE or RFIE on the I-485, any applications based on that (like the I-765 and I-131) will not be processed until that RFE is resolved.

An RFE or RFIE can come at any point before approval. Usually an RFIE for the I-864 will come after a few months of submittal of the I-485, before they issue an EAD or AP.
