@Imej sorry one more question ...

im not quite understanding clearly whether your fiancé was previously the beneficiary in a K1 petition. Was she engaged to a USC previously?

NOA1 New Site: March 6th, 2018

NOA2: Sept 12th, 2018

Case # available as well as case leaving NVC both on Oct 1st, 2018

Embassy received on Oct 2nd, 2018

Medical Appointment Oct 12th, 2018

Interview at Ankara Embassy on Oct 22nd, 2018 - APPROVED!

POE San Fransisco on Dec 1st, 2018

Married Dec 10th, 2018

NOA for I-485/765/131 Feb 1st, 2019

Interview for I-485 June 19th, 2019 - APPROVED! (Interview was before we received Work Auth Card!)

Timeline

The embassy replied to my fiancee email stating that her case under AP (and it has been a month now). However, the Visa status on the website stats "Refused" ... Not sure what to expect next? 

I, the petitioner, didn't receive anything from USCIS neither.

Maybe it is all moot now, but I am still unclear about a few things:, based on your comments:

  • Before the interview, how much time did you actually spend together, face to face? Was that in Pakistan or UAE?
  • You were married twice before (as was I) , you put all the required information on the 129F?
  • Were you ever a beneficiary yourself?

i feel for you, but I'd love to understand a bit better, why this happened.

Just here to say that denials are absolutely heartbreaking, and that I am sorry to hear about this. Please don't give up, spend more time together, get married, and re-apply for the CR1/IR1 visa when the time is right and you have plenty of evidence.

After inquiring, this what I got..

Since the I-129F petition has been returned to the USCIS, all action on this petition is concluded and the petition will not be revalidated. 

For I-129F Consular return cases where the K-1 visa was not issued, the USCIS may not be issuing any further notification about the case to the petitioner. In this instance, the petitioner may choose to file a new Form I-129F, Petition for an Alien Fiancé(e), with fee.

But why?  You will have the same result.   Why not just get married and file for a CR-1?

Sorry to hear about the refusal. 

I'm thinking the week together is a problem. 

No, never a beneficiary, though this is my second petition for a K-1.

 

You may have to do CR-1 at this point.

One of the benefits for a spousal is that it can be appealed if it is sent back to the USCIS where as a K1 goes back to die.
