uscis and the I-797, Notice of Action

Hello All,

I have a question and hope someone can help. I see on the web site that the USCIS is now working on I-485 green cards of a receipt date of 14 October 2006 now. My question is, are they going by the Received Date or the Notice Date on the I-797, Notice of Action. My wife has a Received Date of 10 October 2006 on her I-797, Notice of Action and her case has not been touched at all. The Notice Date on the I-797 is 24 January 2007, which date do we go by.

If her recieved date is October 10 and the website shows they are processing October 14 she is now outside of processing time. You can always call the USCIS misinformation line but it might be more effective to make an Infopass appointment and find out what is going on. The other option is to contact your senator or congressman's office to ask them to make an official inquiry into the status.
