yes, I will be submitting my I-485 with the expired I-94, status "has not change since arrival" is what I put in question 24;

Your I-94 expired 08/13/2018 but, you are submitting your I-485 now, right?

who has $1200.00 after spending  money on expensive airline ticket and associated cost such as medical, VISA cost, police report, hotel stay, and what I spend to travel to Nigeria was extremely expensive

You are saying you are late with your I-485 due to all of the financial expenses you had, right? I hear you, it is very difficult to keep up with the costs of these forms nowadays.

you are not late with the I-485, because there is no requirement or deadline to when it can be submitted;

my cousin submitted the I-485 a year after his wife arrived

I meant late as in after the 90 days, I apologize for the confusion.

we were married within the 90 day requirement and I have our marriage certificate which suspercedes everything,

you can file  I-485 when you get all the money together; because you are already married to your wife;

there is nothing anybody can do; you want have any issue with US immigration;

I should be fine with the Adjustment of Status package fee. I am currently just trying to compile all of the documents I will need, though. It is taking longer than I expected.

How did you put it? I agree with you. I think adding it as "K-1 Visa Holder/Out of Status" sounds very appropriate.

I dont have your same problem but I DID do some research in the chance I did file AOS after my I94 was expired. Like I said, there were many different answers from immigration lawyers online and I came to the personal consensus that IF that was my situation, that's what status I would input personally.

I still suggest doing some research outside of Visa Journey.

Yes, I have done some research for this question. I came across many different types of answers. I've seen the one you mentioned, which is "K-1 Visa Holder/Out of Status". I've also seen "K-1 Visa", "K-1 Visa Holder", "K-1 Visa Holder/Expired I-94", "Status Not Changed", some people who left it completely blank, and so on.

I even saw somebody who said to "File an I-130".

Hello, guys!

On the I-485, what would you fill in for Question 24 in Part 1 that asks what your current immigration is? (for someone who came here on a K-1, got married within 90 days but, with an expired I-94?) Would we put K-1 Visa Holder or Out of Status?

Many thanks in advance!

You put K1 Visa Holder.

By filing your AOS, once it is accepted you are no longer considered out of status after the I-94 expires.

ROC Filing:

4/21/2021 - Sent ROC Package via FedEx

4/22/2021 - FedEx package delivered and signed

5/11/2021 - Check cashed

5/14/2021 - Received NOA1 via mail (NOA1 date: 5/8/2021)

6/9/2021 -  Biometrics waived - Case updated to Fingerprints taken
