Gone through K1, got married, SSN, AOS, and BIOMETIRCS. She's been staying here for 4 months now but things just can't seem to work out for her. She doesn't like life here in the US and wants to go back to her country (PHILS). Do I just buy her the plane ticket home and she'll be alright? Will she need some important documents? Will she be questioned at the airport etc( She has no plans on coming back to the US. ) I may get an annulment soon but she wants to be out of the country before this month ends.

any adivce?

Under what terms do you think you qualify for an annulment?? Also, you should divorce before she leaves, otherwise it will take you much much longer.

How about calling USCIS that you withdrawl or want to cancel AOS? Why have them process your file when its a waste and only makes others wait longer.

it's a long story. bottom line is - she doesn't want to live here. she resents it, she regrets it. i tried to make her happy but it just isn't working. so do i just buy a ticket and send her home? no questions asked by immigration officers at the airport? i just want her to be happy. if that's what she wants, i can't force her to keep staying here.

She can go back home at any time. As long as she is legally "in status" it shouldn't be a problem if she decides to come back some day as long as she hasn't overstayed her visa. If that's the decision buy a ticket and send her home.

Sorry to hear this..but, as said above - File the divorce while she's here - depending on the state you're in, it might not take very long, at least get as far into it as possible (with signatures etc) - so it's a clean break.

Buy the ticket - you might buy a round trip with a return date maybe a few months down the road..just in case ;)

There's no immigration issues when leaving the US - course she needs a valid passport to board.

No, there is generally no "exit interview" at airports. You don't need permission to leave the USA, only to enter it.

That may be...but if she leaves the country without AP (advance parole) and you two reconcile at a later date, you will have to file a spousal visa petition for her, esentially starting all over. She cannot just enter the country just because she's still married to you. Just something to keep in mind.

Oh my, so sorry to hear of the sad news. I sure wish I could do something to help you both...her homesickness and difficulty in the adjustment stage is something I sure understand as I am also working on the issue, esp if she is not working yet and has not yet found her own circle of friends.

Perhaps you can patch her up with some friends or have her call some VJers who are already in the USA and have unlimited national dialling...some of us VJers call each other on the fone and talk for hours as we help each other in the adjustment stage.

You can post me a message and I will try to do my best to discuss the matter with her in the hope of clarifying some issues on adjusting to life in the USA...believe me, it is a work in progress and does not happen overnight.

You are so brave and gallant in wanting to give her happiness...truly a great man.

* Maria's AOS biometrics appointment 5-22, son's on 6-5, no update on EAD status yet

* rcvd AOS appointment 5-26, set for 7-9 in Bloomington,MN office

* applied for Maria's WI state ID 6-5 & card rcvd 6-11

* AOS approved @ 7-9 interview, told to expect green cards 5-30 days
