K-3 AOS interview without husband

Hello Everyone. I need your help!

My USC husband and I have been married for over 3 1/2 years, we have been separted for a year and about to begin divorce proceedings. Yesterday I rec'd appointment notice for AOS interview for me and one of my girls AOS appt. scheduled for 5/30/2007 in Atlanta. I am hoping that I will receive notice for my youngest daughters interview date in the next few days and that it will be for the same date. My husband and I have not spoken much in the past 6 months. I plan on asking him to accompany us to the interview so he an explain that our marriage was bonafide. I am wondering what will hapen if he refuses to attend the interview. Will we be automatically denied because the K3/K4 is a marrige based visa? Or will they consider evidence to prove that marriage was genuine? Do anyone know of anyone who was in a similar situation?

I plan on still attending without my husband if he refuses to attend and trying to demonstrate that your marriage was genuine. I have a lot of evidence to support a genuine maariage, we dated for over 7 years before getting married. I have plane ticket stubs from vacations we took together, trips he took to visit me and trips I took to visit him in Atlanta and his family in Maryland. The children have also visited his family in Maryland. I have some e-mails he sent to me, cards etc. Pictures of our destination wedding in Jamaica and from reception in Canada, from vacations, pictures of him in Canada with my children when they were very little. We also have two years of joint tax returns, my vehicle was covered on his insurance, and he is still listed as a beneficiary one on my life insurance policy from Canada. I have tons of mail addressed to me at our old address. My husband purchased the home after we got married, I have e-mails he sent me asking me about home preferences.

Any help will be greatly appreciated. Thank-you in advance for your replies.

Just wanted to say I hope all is well at the interview. I don't have anything to offer, but a bump on this thread..

if he doesnt attend the interview with you will be denied and put in removal porceedings ,those evidences you can use them if you are a conditional green card holder and you got divorced but now you status is not even adjusted so you will have to adjut your status 1st but you cant not do it without the sponsor ,which is your husband ,the only oprion you have is to ask him to attend the interview with you as a favour .

Successful adjustment will depend on whether USCIS considers the marriage still viable. You really need to consult an immigration attorney now before the divorce is underway to discuss any and all options. Frankly, if you are the one that is precipitating this divorce, I'd cool your jets for a while.

You really need to consult an immigration attorney now before the divorce is underway to discuss any and all options. I asked USC spouse if he would attend and he said no. I plan on visiting Catholic Charites office next week for advice and to obtain legal counsel to attend interview with me if possible.

The reason for the marital breakdown is because I discovered that he is gay or at least bi-sexual and was leading a double life, he was on the phone to gay chat sites and looking up gay porn on the internet. I found drug parafanailia in his car, receipt for motels, phone bill showing excessive hours talking to male sex lines. Furthermore he kept forcing me to get a job when I was really sick. The second day on the job , I fainted and had to have 4 units of blood transfusion, doctor said my iron was so low due to fibroid problems that i could have easily had a heart attack. I needed to have surgery to remove my fibroids and he would not pay the $1500.00 deposit, so I had to postpone it until I could afford to pay myself.

He is doing all of this because he wants me to return home out of fear the truth about him will be exposed. I have a letter he wrote me trying to explain the phone calls to gay sex lis, the internet gay sites and drug use etc. Furthermore I only found out after moving in with him that he suffered from depression and was on antidepressants. My spouse had agreed to attend interview and tell adjudicator the truth about our relationship, but now he has had a change of heart , partly because I refused to sign a separation agreement he drew up where he made false claims like there was no marital property and that we agree to not rely on State Divorce laws, but this agreement instead and that the agreement could not be modified by me , but must be accepted in its entirety. As an educated woman there is no way I was about to sign such an agreement. I have suffered enough emotional abuse trying to deal with this situation, I am not going to allow him to further blackmail and victimize me.

I would consult a good attorney. As well keep all evidence. Hope it works out.

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

Depending upon how long you've been married (and whether or not that would entitle you to any appreciation of the marital estate) you might wand to speak to someone about annulling this union. It seems to me his sexual orientation and private life choices, that were not revealed to you prior to marriage, would fall under one of the criteria where the courts consider annulment is available.

If you annul the marriage doesn't that mean you can't file the I 360 under VAWA?

I needed to have surgery to remove my fibroids and he would not pay the $1500.00 deposit, so I had to postpone it until I could afford to pay myself.

He is doing all of this because he wants me to return home out of fear the truth about him will be exposed. I have a letter he wrote me trying to explain the phone calls to gay sex lis, the internet gay sites and drug use etc. Furthermore I only found out after moving in with him that he suffered from depression and was on antidepressants. My spouse had agreed to attend interview and tell adjudicator the truth about our relationship, but now he has had a change of heart , partly because I refused to sign a separation agreement he drew up where he made false claims like there was no marital property and that we agree to not rely on State Divorce laws, but this agreement instead and that the agreement could not be modified by me , but must be accepted in its entirety. As an educated woman there is no way I was about to sign such an agreement. I have suffered enough emotional abuse trying to deal with this situation, I am not going to allow him to further blackmail and victimize me.

Depending upon how long you've been married (and whether or not that would entitle you to any appreciation of the marital estate) you might wand to speak to someone about annulling this union. It seems to me his sexual orientation and private life choices, that were not revealed to you prior to marriage, would fall under one of the criteria where the courts consider annulment is available.

If you annul the marriage doesn't that mean you can't file the I 360 under VAWA?

Well if the OP is attempting to claim abuse...but I think anyone that was abused would hardly invite the abuser to join her. No?
