I actuall have read as much as I can on the guides and then also the USCIS site. I think I have found a conflict so if anyone knows the answer to this.

First, I believe that my income must support, him, me, and any children that are my dependents, and his child, even though the child is not coming with him. Am I right in believing therefore I must have enough money for a family of 3?

Second, on the affidavidt of support it does ask you if anyone is partially dependent upon yuou. While I find this odd, it does not fit with tax status of dependent upon me..so I woudl say no...however....I would help my child go back to school this fall, then he is partly dependent (for purpose of waiver it is possible)

I-134 is talking about how many people you will be supporting here in the states at the time the Visa is issued. If someone in the family is not coming, there is no risk they'll ever go on Public Assistance. So your answer is 2.

In your case, I'd say there is no one "partially dependent" upon you.

July 18, 2007 - Biometrics completed

July 20, 2007 - Case transferred from MSC to CSC

July 31, 2007 - AOS Approved - 57 days - Without an Interview!

Aug 06, 2007 - Received Green Card in the mail today!

Jan 8, 2009 @ 8:18PM - Our son was born tonight !!

I-751 - Remove Conditions

July 11, 2009 - Certified Mail to VSC I-751 Package

July 14, 2009 - Check cleared bank

July 20, 2009 - NOA1 & 1 yr extension - Receipt date is July 14. Case# assigned

Sept 1, 2009 - Biometrics completed

Nov 25, 2009 - I-751 is approved. No Interview.

Dec 14, 2009 - 10yr Green Card arrived !

Don't know if 3 is right or not - you don't mention how many dependents you have. But you will not have to consider your fiance's child if his child will not be coming to the USA with him.

A person is partially dependent on you if you are providing only a portion of their support, and someone else is also providing a portion of their suppor. A quite common situation for a divorced parent.

Thank you guys! Now to do it (it is mostly done) but, on my original applicaiton I only showed one job (I have had it for the past 8 years or so). I am now commission for 2years of it however. I also have 2years of self employment and while I didnt show it, I almost think I shoudl have, and am considering showing it now.I didnt think about the income aspect of the application when we filled it out, and Catholic Charities said, oh dont worry they dont care you are employed together (nto thinking we made decent income in it)

We are sure to get a RFE, my SO just put Self Employed, no details. He and I have had a business together for 2 years now, and there certainly is profit.

Last year he took out more profit then I did, this year I am taking more.....I wonder if we do a corp resolution stating my new income, (and ahve a few months to back this up) if that will help...plus the other commissioned income......

somedays, I miss the paycheck day...lol.....
