Questions regarding the instructions for the new form I-129f

The latest I129F form seems to have some issues with the numbering system

For example: Instruction section 1 C refers you to Question 11 later in the document for K3 specific requirements. This clearly is an error since it should say Question 10.

Here is my question: If you flip to Questions 10 (How Do You Use This Form for Your Spouse Seeking Entry With a K-3 Visa?), the second para is quited below

"You must submit the documents required in Questions 3, 4 and 6 of the instructions, but may omit the documents required in Question 5. In addition, U.S. citizens petitioning for K-3 visas for their alien spouses must also include evidence that they have filed Form I-130, Petition for Alien Relative, on behalf of the alien spouse listed on this form, and a marriage certificate evidencing the legal marriage between the citizen and alien."

They state that documents required in Questions 3, 4 and 6 of the instructions still apply and that we may omit the one required in Questions 5.

3. Compliance with the International Marriage Broker Regulation Act (IMBRA). REQUIRED

4. Filing Limitations on K Non-immigrant Petitioners. REQUIRED

6. What If a Document Is Not Available? REQUIRED

5. What Documents Do You Need to Show That You Are a U.S. Citizen? MAY OMIT

This does not make too much sense to me (e.g. omitting the proof of US citizenship) and i was wondering if they have all the numbers screwed up.

Hm, weird. Definitely send proof of citizenship...

When I sent mine in, we filled out all the questions, sent all the evidence. The only thing we did different was answer the questions as N/A where specified for K3 applicants.

Yes, this is screwed up and I posted about the same thing! Look at the guides for what to send, but it's probably the things you are thinking. In my case I didn't send all the evidence again that I sent in the I-130.

I was thinking of photocopying all the evidence sent in the I-130 and including them in the I-129F.

Any negative consequences?

Good question. I looked at this too, but I had a simple solution, I had a copy of an older version of the i129f (which you can still find if you google it).

This is 2 versions ago, when the K3 stuff was question 10. You may omit docs listed for current form's instructions item 7, the docs showing you are eligible to marry (because you already are married for K3!!), letters of intent to marry, and proof that previous marriages have terminated.

The stuff that you must provide are:

compliance with IMBRA as in instructions item 3

proof of citizenship as described in item 5

other items as proof/evidence if documents are not available as in 6

Nothing wrong with photocopying evidence.

i meant is there anything woring with including too much evidence that might not be 1005 relevant?

example include in both I-103 and !-129F an 80 page appendix describing (with photos and phone records) our 1 year pre-marital relationship. i won't have much evidence post-marital except for affidavits and the marriage cert.

80 pages? Well one thing is that I believe that the adjudicators are required to look at everything you submit... so if you submit too much they might put you to the bottom of the pile and work on "easier" cases. 80 pages seems excessive...
