You need to provide either:

1) A tax transcript

OR

2) A copy of the federal tax return + all supporting schedules (W-2s/1099s/etc.). This doesn't verify you actually sent the tax return, but it is acceptable to USCIS along with the I-864 stating that you did do so under penalty of perjury.

NOTE: Do not mix and match the criteria above...it's one or the other.

 

It's usually much simpler to use the tax transcript. You can get them online and print them from the IRS almost instantly: https://www.irs.gov/individuals/get-transcript

Thank you - I will go to this website and get these. If that is "better" I will do this. And I won't mix and match :)

+ additional cause I know you are using a co-sponsor:

 

I am not sure if your brother is married. If he is married and filing jointly, Then Tax transcript + W2 to show his individual income.

And if the joint sponsor files jointly with a spouse, an I-864A is commonly requested from the spouse.

 

I hate the confusing rules....but yes, a transcript plus evidence of his individual income must be shown as well...in which the "don't mix and match" piece gets very confusing as this case does do it.

I'm sorry for slightly hijacking, We didn't send I-864A with my aos as my co-sponsor is sponsoring us by herself. Does this cause RFE then?

Eek! Good catch...I got tagged and overlooked that it was still the K-1 process. Whoops....no I-864 or I-864A involved (with a couple exceptions to the rule with some consulates that want an I-864 still).

It's not strictly required, but they have sometimes issued an RFE in the past in that case.

Well she will need I-864 soon too so it is always good to know one step ahead :) 

 

I hope I won't get an rfe though... Good to be prepared still... I'll ask my father-in-law just in case.

@Naes what do you mean by "+ additional" you mean additional years of taxes ? 

no he is not married so it's just his income.
