I-130/ & I-129f ???

A close friend of Mine recently married his wife in her home country,

he needs help on what to file first to get her AOS process started.

I read the K3 general info

I just have a few questions or rather need Confirmation on the order of filing the forms.

Step 1 : He files I-130 along with G325 a's and I-864

Step 2: when his Wife arrives USA they File I-485?

My question is does he need to file I-129F or does he need to marry her in the USA even thouigh he already married her in her home country?

OR does he still need to file I-129F after receipt of NOA even though she is his Spouse not Fiance?

Please advise..

He can file an I-129F after the I-130 to get his wife here faster. Even though it says that it's for your fiancée it can be used for a spouse as long as the I-130 has been previously filed.

Once his wife receives her visa she will come to the US and that's when she files for AOS. They don't have to remarry here in the States.

Step one I-130 and G-325, the I-864 comes later either from NVC or after entering on a K-3 visa and adjusting status.

Step two when I-130 is received and have notice of receipt, then file I-129F to start the K-3

Step 3 after arriving in USA on K-3 visa then do I-485 and I-864

Used to be that gettting here was much easier if you were not yet married. The 129f was much faster and for fiance's only. 10 years ago they changed so it so spouses can use the 129f "hunny bunny" form as well - although it is still faster if you are only a fiance.

My wife & I are fortunate that she was already in USA when I filed i-130, our process took less than 6 months.

My friend kind of went about the process the wrong way, I had told him it woul dbe best if his ( at that time Fiance) came into the USA legally and he marry her here, that way he can file I-130/& AOS concurrently. They have a 20year + history, proving legitimacy of their marriage will not be a problem.

He will now have to wait out the drawn out process of getting the K-3 Visa & then filing AOS later.

I commend my friend for going about the process the leagl way, it is unfortunate that those who do things by the law are penalized and those who are federal criminals and Knowingly break the law get treated with leniancy and are not made to be accountabale for their actions.

Please tell me if the following is correct as Initial Submission

I-130 + G325 for both US citizen and Foreign Spouse

Certified / translated copies of

-Foreign BC

-Marriage liscense

-Term. of previous marriages

US Citizens BC/ or passport

2 passport photos US Citizen

2 passport Photos Foreign Spouse

Are we missing anything? for Initial Submission to start the K3 process for Foriegn spouse of US Citzen.?
