Hey all.

 

So I just returned from a trip back home to the UK, and as I was coming through immigration back into the United States, the guy who dealt with me mentioned that my green card was getting close to expiring (June next year). He told me to file early as there is a huge backlog.


I was under the impression that you had to wait until a specific time frame (90 days before GC expiration) before you could send off ROC paperwork. Is this the case? Or is it possible to get started now?

 

(Oh I came here on a K1, we got married, did AOS, got approved in June 2017, my card expires June 2019)

If not filing under a waiver of the joint filing requirement then, as stated, the earlier you can apply is 90 before your card's expiration.

 

If you are filing under a waiver of the joint filing requirement then your filing window opens immediately when your eligibility for the waiver does.
