From the USCIS website: "You may file Form N-400, Application for Naturalization, 90 calendar days before you complete your permanent residence requirement if your eligibility for naturalization is based upon being a:

The main body of that post is this:

 

Generally, USCIS officers must interview a conditional permanent resident who is the principal petitioner on a Form I-751, unless the interview is waived. This guidance explains that officers may consider waiving an interview if they are satisfied that:

  • They can make a decision based on the record because it contains sufficient evidence about the bona fides of the marriage and that the marriage was not entered into in order to evade U.S. immigration laws;
  • For Form I-751 cases received on or after December 10, 2018, USCIS has previously interviewed the principal petitioner;
  • There is no indication of fraud or misrepresentation in the Form I-751 or the supporting documentation; and
  • There are no complex facts or issues that require an interview to resolve.

So, do we think that bullet point 2 means that if you didn't get an AOS interview and you're sending your I-751 on or after Dec 10, 2018 they will make you have an interview regardless? I guess it doesn't matter for those of us in this forum given the filing change....but does anyone know about whether the interview was required if the petitioner did not have an AOS interview before? 

They also waive some interviews on the i751 when you file for naturalization. You still get an interview but most  questions are based on the N400 cos you have to pass the tests and it's mandatory. 

 

If you file a combo, you can still go with your Spouse, but in most cases, they've been so busy that the agents didn't even call the spouses in. They just waited outside all the time.

Thanks for your reply. They have a copy of my green card - and it came up on their system I guess. My submission for ROC is enough? Is there any official documentation stating this in USCIS website or elsewhere. I can't find it..

If your company has a copy of your green card,  it's definitely normal that the system will come up with a reminder regarding the expiration of your work authorization. Most companies use the I-9 Service Center for work compliance, which usually sends you a message of this kind: 

 

This is a reminder that you are required to present documentation that you have continuing authorization to work in the United States. At the time you last completed an I-9 you indicated that your work authorization will expire on ....2018. Therefore, you must contact a CSA in your local field office and schedule a time to present original documents as soon as possible. A list of documents that will evidence your continued authorization to work are listed below..."

 

If you don't have a NOA1, you are definitely welcome to schedule an infopass appointment at your local uscis office and get your passport stamped with a 1 year i551. That allows you to work,  study,  travel...ect.

Some good news for Nebraska (LIN) folks...I received my biometrics letter today. Online sent states 5th October, actual letter dated 12/07 posted 11th Dec. Looks like they have finally started moving... 🙂 About 2 months behind.

Thank you for the link. However, when I put in my anniversary date it puts in a date prior to the 90 day period, so I am confused now about that. I my anniversary is in November 2019 I don't think I can apply for citizenship early June 2019.... that's what the calculator gives me!

An update on my Infopass appointment today. All went well. They didn't take in my Green Card. Stamped my passport for a year extension and said that they couldn't see anything other on my case than that they are working on it. I asked what would happen if I would get my biometrics letter while I was traveling. She said I would just have to make an infopass appointment when I'd get back if I missed it and they could see in the system that I had missed it and could even schedule it while I would be there. Get it right away. Same with the stamp in my passport; if I would not have received the NOA by next year I'd just have to come back to get another stamp. Oh, and also, if I would have missed the biometrics appointment they would send out another letter. It didn't sound like it was a great deal to miss a biometrics appointment.

As to traveling with the stamp in my passport she said I'd have to present my Green Card ánd the stamp so they could see at immigration it has been extended. So I definitely don't think it's normal that they take your Green Card.

Another useful tip; she said that any infopass appointments available would be posted at 7 am. That's when I got mine too; I don't know if this is true for all field offices but it's worth trying if you want to get one. We had to wait an hour and a half before it was our turn but yay, got the stamp 💃

Hi,

To use the CALCULATOR,  you need to enter the date of your 3rd year anniversary from the issuance of your first green card ( even if expired)

For instance if the issue date is November 10 2016 ( must be 2016 if you are removing conditions this year), then your 3rd year anniversary is November 10 2019 minus 90 days,  your open window starts (from the CALCULATOR) at August 12 2019 ( it's equal 90 days to November 10 2019).

 

But you can just guess it by yourself if the CALCULATOR doesn't give you the right date. In your case, if your anniversary is in November 2019, your window must start sometime in August 2019 for sure.

Can't they ask for proof that you are legally authorized to work in the US? If your work permit expired, aren't they able to ask for new paperwork?
