They did and I also had a lawyer and that did not help me. My divorce certificate was missing a box check. I fixed it and after almost three months after I sent RFE response they denied me. The decision was made long before but they did not bother to send me the decision. Only after I involved the Congressman they sent me something. Yeah I had a terrible experience. They said they considered I was still married when I applied for k1. Of course it was a BS. Some of the people that works there are simple incompetent. I talked to a different lawyer and he simply suggest me to reapply because he said it did not make sense to fight them. It is a little bit of abuse of power at USCIS.

Too bad and what a sad experience! I wish you all the best luck this time!!!!!!! 😀😀😀

I spoke to a tier 1, i called as soon they were open. I started off by stopping her in the middle of her usual questions to ask how was her day going then i proceeded to check if they had to correct adress since i just changed it, after she confirm it i then explained that i knew my case is still in normal processing time but i just wanted an update to see if anyone has even started reviewing it, she put me on hold and then congratulate me on the approval. I know the wait is hard but Good luck to you all.

You are super lucky!

There may be some different options but I believe you will have to post your question with a new thread https://www.visajourney.com/forums/forum/80-k-1-fiancee-visa-process-amp-procedures/. There are many experts that do not venture into the Monthly K-1 threads so you need to spread your wings a little and see if they can help you with what your options are.

I am all set. Thank you. I applied the second time, I have a lawyer and I am just waiting like everybody here. I am also October filler of 2018. My lawyer said if I apply the second time is considered a new case. So we will see what happens. I was not looking for an advice I was just sharing my experience.

So let's say someone had an identical case like yours and they were able to move forward and get a visa, you wouldn't be interested in what they did to receive their visa so that you might try the same thing and not have to go and start over? I would recommend being pro active to achieving your goal which is a visa. What do you have to loose?

Trust me I was very proactive, I called 5 different immigration lawyers. I went to USCIS for info pass appointments twice and they all told me the same thing. To reapply. Back then my only option was to hire a family lawyer that would prove I was legally divorce and contest USCIS decision. That would cost me more money and contestation of a decision takes longer wait than the total time for the entire k1 process (6 months to 1 year in some cases). In majority cases they are deny you if you fight back their decision. In less is their fault. So it was simple to reapply.

Everything is in past. I hope the second time it will be better and I will get an approval. Despite everything I went thru I am an optimistic person.

We’ve just called and the agent we spoke to was very helpful, whilst our case hasn’t yet been approved they told us that we are in the final stages. Hoping to hear something more this week.

What questions did you ask them to get them to say this? I struggled with what to ask when I talked to them.

It was my finance who called, he’s just about to relocate back to America (with work) so we wanted to check they had the new address just in case they sent any mail here after we’d moved out.

The guy he spoke to was just really helpful, I think we got lucky and he gave us the update with little prompting.

I am hoping my fiancée just spoke to the wrong level, and in fact we are in the later stages (similar to yourself). Be sure to let us know as soon as you know! :D

Also, do you know if you spoke to Tier 1 or Tier 2?
