First, the only original documents are from the beneficiary at the interview. They can bring a copy and the original and submit both and ask that the original be returned. Happens all the time.

 

Second, is no knows why your file seems to go and return like a yo-yo. But, the action that you can take is to call weekly and get either a tier 2 or supervisor. They are the only ones who have any authority to look further into your file. Now, have said that, it doesn't mean you are going to get an answer or that you are going to get an answer that you want to hear. Be very civil and at best explain your frustration of not being able to get a clear answer of where your file is, when will it return to NVC and when will case number be assign so that the file can be sent to USEM.

 

Third, we just happen to know your embassy is manila because you said so but if the page changed I wouldn't know where you are interviewing with what embassy. Many of our answers are predicated on the information you supply in your profile. When we look at the left column and can't determine your timeline OR your Embassy it's hard for us to give you a factual answer. If you look at the profile of others here, they have a flag for their country, so it makes it easy for us to reply as we can quickly determine your Embassy. Our answers will sometimes be tailored to a specific Embassy hence the reason for you to complete your profile.

 

So, if you could help yourself out and complete your profile that sure would help us out when we want to reply to your question with factual information.

Fourth there is a possibility that USCIS did not close out your file properly and NVC will catch those records and return them for USCIS to complete the adjudication process. They look for a red stamp (completion stamp) and the check that ALL three security questions were answered in the I-129f. If they weren't they are sent back.

If we are late and can’t file our marriage/adjustment of status by the K1 expiration, is this okay? Does anyone know if we NEED to file our marriage/status change BEFORE the k1 visa expiration? Ours expires on April 15th and we got married in the 90 day time frame but am waiting on my 2018 tax returns from my accountant to file for the I-864, AoS, EAD, AP..we are cutting it really close and am not sure if this is going to be a problem.

Better not to be late, but i'm sure nothing will happen if you'll file couple days later. As long as you get married within 90days of entry.

I hope so..or maybe we can file everything else separately and atleast get in the 485 but I know it will cost more money to do it separately :(

Have i485, 765, 131 filled out and ready to go with all supporting documents, put in envelope.

I864 leave for the last, fill out, just leave the spots where income in digits have to be put in.
Once you get your tax return papers, fill out i864, attach the 1040 +w2 and go to post office.

Likely that you'll receive the paperwork before the deadline, just don't leave extra work for yourself. Get everything ready, and once you get the papers from accountant, fill out what's left on i864, ship it out same day..

Don't wait till the last second to fill the forms, as they are a handful. Additionally, in a rush you're more likely to make an error. While you have time, get it prepped.

Take your time and finish your paperwork. I have seen others who have waited a year to file AOS and nothing happened to them. So a few days or weeks is not a concern. The K-1 is DEAD. There is nothing more you have to do with the K-1. You can use 2017 to file the I-864. The rule is if you have filed your taxes then use 2018 if you have not use the most current tax filing and that would be 2017 in your case.

 

Ok. Take a big deep breath and let it out slow. Feel better? :D

Ahhh that exhale felt good. I do feel better now. I will unfortunately have to wait for the 2018 ones since I already filed those taxes but that's fine now that I know the expiration date doesn't matter. I mean after all...we signed paperwork on the I-129f saying we promised to "get married within 90 days"...they never said anything about "filing within 90 days" :) of course though...the sooner we file, the sooner the results! Thank you, @Greenbaum

We are now filing now for AoS, EAD and AP and am wondering if there any additional relationship evidence that we need to include like we did for K1? We are doing the I-485, the I-864 and have included our apartment lease, our joint bank account statement, our joint car insurance, and our marriage certificate. Is there anything else that people are doing such as receipts of wedding venue, photographer, wedding pictures? Anything else to support your case or will those pictures only be needed for the interview?

Nothing else apart marriage certificate is need to file AoS, EAD, AP.

Plus you need 2x passport pics for each form, Vaccine copy from surgeon or if you have it marked as "complete" by medical before K-1 interview. Marriage certificate (use certified copies, people reported getting RFE's for usual copies)

I'm sure i'm forgetting something. But there is no need for proof of relationship, as you'll have interview, THATS when you'll have to come up with that.

I am sending the AoS, EAD, AP forms.  Now I am being confused....

1.  do I need to add a letter detailing why I am only paying the $1225 to file all 3 forms?  I don't want USCIS to send me a bill for $515 because I am filing jointly all three forms.  I have read someone got their packet sent back and asked to pay the additional funds.

On the cover letter i specified that xxx amount was to cover these fee’s and EAD AP are waived by default if filed concurrently with AOS. No RFE and money deposited.
