So again, @DeepakChani, this is not the reason for your RFE unless they lost your MC entirely.

I can confirm that a photocopy of you marriage certificate is just fine I even asked this question back when we filed to my lawyer and he confirmed just a photocopy is just fine.

I hope no one receives an RFE and that everyone get approved. This is my understanding of the language that they use. If you google there is a lot of discussions about this. I submitted a certified copy by the state that's what I believe is the most appropriate. Even when my wife changed her name on  SSN they requested certified copy of marriage license and not just a photocopy.

It's fine if that's what you and others have understood but it's not true and shouldn't be claimed as true here as that is misleading. 

 

SSA will only accept an original or certified copy of the MC as that is their policy and they are an entire different government entity.

 

USCIS policy allows photocopies to be submitted with the application and originals are to be brought to the interview. If that was not the case, surely all of us would have been given an RFE and this would not even be a discussion.

That's fair enough! And you've not done anything wrong by submitting a certified copy - at least you know it isn't something you have to worry about there!

 

I think everyone has their own interpretation of the way things work with USCIS; but until we get someone on the inside it's all a mystery! 🤔

Hmmm, it does state this on the USCIS website: 

 

"If you are filing Form I-485 as the derivative applicant spouse of the principal applicant, you generally must submit a photocopy of your marriage certificate issued by the appropriate civil authority where the marriage took place" - https://www.uscis.gov/sites/default/files/files/form/i-485instr.pdf (page 10)

I'm not trying to hurt your feelings. I'm trying to prevent others from receiving bad advice based on other ppl's interpretation of the instructions. 

You can make a suggestion all you want but your original comment insisted that the thousands of us here were sorely incorrect for following the instructions and submitting photocopies. That cannot be the case though as all of us who have recently submitted would have RFEs and the rest who filed before us would have told us photocopies are not accepted.

It does not say a certified copy. Its saying a photocopy OF the marriage certificate THAT WAS issued by the county.

 

Saying the marriage certificate that you photocopy YOURSELF must have been issued by the county.

From what I understand, the AP doesn't update but you should get the EAD/AP card all in one. Let us know, and congratulations! :D
