Everyday that you do not file AOS beyond the 90 days, you no longer have lawful status and you are accumulating days of overstay. While most days of overstay are forgiven after you apply for AOS because you have married as you were supposed to, during that time of unlawful status, you can be brought into immigration proceedings. While most judges will only force you to file for AOS at that time to avoid deportation, with the current government, you never know what new policies may develop.

 

So if his i 94 expired, is it still helpful to file EAD with AOS?

My understanding is that there's not very much in the way of documents required to file the I-485 (and I-765 and I-131); lots of people file within a few days of a marriage shortly after POE.

 

You'll need more documentation for you interview, but the USCIS web site says the Boston field office averages 7.5 to 11.5 months for AOS, so you'll have time to put it together.

Thank you! Its just coz his i 94 expired on dec 3 and most probably we will be sending the AOS this week. Im nervous that they will have some issues since we are filing with an expired i94 😭😭

They won't be any issues for filling a few days after your I-94 expires. Just don't run into a border patrol agent right now 😁

Well technically you got married during the 90 days so you did your part of the contract and respected the conditions of the Visa. Never read anything from the USCIS saying that the AOS must be filled during the 90 days, it is just that you don't really have a status between your Visa expiration and the moment the USCIS get your AOS Application. I am not a specialist but never heard about anybody being in trouble filling a few times after their K-1 visa expired.

Ive been googling about it too and its stressing me out. Thanks for makig me feel better. We will send the applications for AOS, EAD and AP this tuesday or wednesday.

Just make sure everything complete and signed even if it takes another day, no need to precipitate now. And one other thing, make sur the payment is good: https://www.uscis.gov/forms/paying-uscis-fees

I did. I  believe our K1 adjustment of statuses go to a lock box in Chicago, then to the National Benefits Center in Missouri, then it to a field office in Honolulu. I have no idea though.

For those that have had their fingerprint appointment? As the USC, did you go with your spouse to that appointment? What was all entailed, any questions for the USC? From the looks of it, it looks like it's just a fingerprint and then off to the waiting game again until the former interview.

My husband went to the office in Elizabeth, NJ. I was not allowed in with him so I dropped him off and waited. He was in there for a total of 28 minutes and the actual process was 2 minutes long. More waiting than anything. It’s fingerprints and filling out a form (weight, height, country you’re from type of questions). The only thing needed was the appointment letter and his passport.

 

Back to the waiting game for us!
