OCTOBER AOS 2018 Filers

I've had the same problem as @pending4ever. My receipt date is Oct 18th, got an RFIE at the end of February, and USCIS received the response on May 9th (well, the status updated on the 9th to say they got it, then also updated to say they got it on the 10th...?). My lawyer tried to send a service request for the EAD for me around May 22nd as I was outside of processing time at that point, but it was rejected because it had been less than 60 days since they got the RFIE response. Then of course a few days later the SR date pushed back to September :(. Hoping to hear about the EAD sometime this week as we're approaching 30 days since they received the response, and we're at 230 days total.

02/28/2019 - USCIS mailed RFIE on I485
05/09/2019 - USCIS received RFIE response

I understand what you mean. You are not mistaken. However I'm pretty sure that verbiage is geared more towards I-485 and you haven't had any updates for EAD in the past 60 days so as soon as the "current processing time" passes your PD, I would call and put in an inquiry anyway. Once my case was outside of normal processing times, I tried to put in an inquiry online and it wouldn't let me, so I had to call to put one in. Regardless of that verbiage you read, still put the inquiry in a soon as it passes October 11. I'm so sorry you've been waiting so long! I had an RFIE too and I just received my EAD yesterday. My PD is October 19. It's soooo frustrating seeing people who applied after you receive theirs before you, regardless of RFIE or not! I hope you hear something soon!

If you are out of normal processing time, and it won't allow you to put in an inquiry online, if you call USCIS they can put one in for you. That's what I had to do. I was outside or normal processing times by 12 days, and it still wouldn't let me put in an inquiry online. They did it for me when I called and explained it to them though.

Did you in the past 60 days:

  • Receive a notice from them about your I765/I131,
  • Respond to a request for evidence for your I765/I131, OR
  • Receive an online update to your I765/I131 case status.

???

I thought you said your RFE was for I485. I765 and I131 is separate.

You are definitely out of normal processing times for your I131.....and if you submit a service enquiry for that it may get the ball rolling on both.

I thought you said your RFE was for I485. I765 and I131 is separate.

I didn't, good point. I'll give it a try. I feel dumb for not having done that on my I-765 when it was already way beyond processing time. Now it's back in late September 😕

Gotta love when you wake up to an email from USCIS, but it just says "We are still reviewing your case and there are no updates at this time. We last took action on your case on May 10, 2019."

How do you set up getting e-mails from USCIS? I only received the emails when they first received my case but since then have just been constantly checking the my case status website. I opened an online account a few days ago (thinking this is how I will get email notifications) and added my cases there, but none of them look updated at all - they are all on "we received your case and there's nothing for you to do at this time".

I can't quite remember. I believe it was through setting up an account on https://myaccount.uscis.dhs.gov/ and adding my case numbers, but I did it months ago, and since then I've had an email every week.

Should be this.  I seem to have missed a few too so I unchecked, saved, and re-checked the options, also making sure it had my current cell number and email in Account Settings.

 

However in researching the bug by looking at emails, I think I found an edge case bug in the notification system.  If you've previously had a K1 Visa case open, for instance, it will report by email periodically "no updates....last action June 2018" for instance.  Because my wife's I-129F and I-765 processes were completed, I removed those cases.  Now I expect to get email updates on the I-485.

Tucson AZ, everything that is on the interview letter list itself + christmas cards, photos, insurance papers, phone/house agreements, birth certificates, etc. basically the same stuff they've asked for 100 times but you have to keep providing over and over lol. I will update here with my experience of the interview itself once its over with :)

Update! : there is no update haha. We had our interview (Grand Junction, Colorado) for our Green card process on April 26, and no news yet about a green card.  For those wondering. Bring EVERTHING related to your case, and obviously the new stuff, marriage cert, bills in both your names, cell phone records, anything that shows you are a couple, new photos etc.   And of course make copies of it all so you don't have to hand over your originals. Our officer had all our stuff with him so he didn't really ask for much, just new evidence if we had it. and the questions were easy, where we met, if I've met her parents, where we live, what we do for fun and then they go through the yes/no questions on the i485 application again.  Basically answer NO to everything.

 

The adjudicator told us it would be a month until we heard anything as he was backed up with cases, and so now we are moving towards month 2 without a word.  not even sure who to call to inquire.  So keep that in mind everyone, even after your interview it might take a while to get your green card in hand, some states are faster than others of course.  We aren't stressing about it too much, because after 2 years of all these processes we have learned to wait patiently, and sometimes calling and calling to USCIS really doesn't do much except cause anxiety and stress.  We are together, thankfully we got the work permission, (months late) but we are at least able to have a normal life waiting TOGETHER!  The stress will kick in if we don't hear anything by october because we are trying to have a 2nd wedding in mexico in december so hopefully the green card comes in then. and  my wife also doesn't want to get her Drivers license until her green card comes through, we can go to SS office and get an official name change and then go to pass her DL test.  

 

Anyways hope all who are still waiting can hear something soon!

Well I woke up from a nap to a case status email. Finally!!!

 

Shame it's another bloody RFE on the I485 :(
