Hey Octobears,

I couldn't bear another day (Day 202) of not knowing where I stand with the EAD/AP situation - so I gave a call to USCIS today to speak to a Tier 2 agent. Spoke with someone today and was told that nothing had been touched on my case since Nov last year! He said that there was a huge backlog at NBC for EAD and AP's and that the last time someone called in he was advised to give the Ombudsman number, especially as I'm still within 'Normal Processing Times', even though I'm about a week away from being outside Normal Processing Times now. He understood my frustration and gave me the Ombudsman number. I proceeded to call the Ombudsman [(202) 357-8100] and they told me just to fill out a form online ( https://cisomb.dhs.gov/oca/form7001.aspx ) - which I have done but don't know if it's gone through as I've yet to receive a confirmation email. [It apparently doesn't work on Chrome or Firefox and you have to use Internet Explorer? - But I managed to work it on Chrome, if I don't receive any confirmation by tomorrow, will re-submit after re-downloading Internet Explorer...]

I am not sure if this will help anyone else, but if it does, glad to pass on the information - I know we are all going stir crazy in waiting. Here's to more approvals this week and some solid responses to everyone whose sent in a case inquiry or RFE/RFIE!

I just tried (at USCIS suggestion) to fill out this form. I used Chrome, Firefox, Safari, Safari Mobile and Internet Explorer and I get this error every time:

Access Denied

You don't have permission to access "http://www.dhs.gov/topic/cis-ombudsman/forms/7001" on this server.

Reference #18.7c393717.1558140745.26237d

I even restarted my laptop, and then tried again on every single browser and I still get the same error.

It's my luck that everyone else can get it to work but I can't. Now I'm 700 times more annoyed than I already was. Anyone have any insight or ideas how I can get this form to work?

Uhm just thinking I was using a UK VPN when I first tried going on the forms and I got the same message as you - maybe try a free US vpn? Maybe your IP address is not registering as a US one? I know I had a few problems getting the form to work the first few times too so yeh.

The only other thing that I could think of trying is trying a different computer if you can get a hold of one...

My husband is a network administrator and says that can't be the issue. We're in the US, and I've been here for almost 10 months (since I'm forbidden to leave lol). It would be impossible for my IP address to be registering anywhere else.

1) April 30 - I sent the request EAD/AP

2) May 10 - I called  USCIS to speak to Tier2 about EAD/AP. They said that I shoud wait.

3) May 13 - I received an update on the site I-485 ( RFIE). I haven’t received the letter with RFIE yet.

4) May 15 -  I called USCIS to speak to Tier 2 about EAD/AP ( no update for today). They said that only after reviewing my Evidence on I-485 they can make decisions on EAD/AP

I hope letter with RFIE I will recieve 17 or 18 on May.

Today, on May 17, I received a letter with RFIE.

" You must provide the following information.......

Submit a completed and signed Form I-864, Affadavit of Support,  for the petitioning sponsor  ( name), listed on Form I-130 or Form- 129F ( The Form I-134 is not acceptable to use for Adjustment of Status)".

I brought for the interview in Ukraine ( 129F) i  and I sent together with  i-485  Affadavit of Support  Form I- 134. It was valid for this time still almost 2 month ( expires 11/30/2018). My recived date 10/4/2018🙄

Even if I made a mistake and sent the wrong form, it only confirms my opinion that the my folder was not opened until I sent my request for EAD/AP.

Now I have a question, what can the phrase mean:

"If you have submited Form I- 864, the version you submitted is no longer accepted. You must submit Form I-864 . All pages of Form I-864 must be present and of the latest edition date" 🙄

In my understanding, this means that even if I had sent the form I-864 initially, then at the moment there is some new version of this form and in any case I would get RFIE. What do you think guys?

Hi Ira,

I'm new to the forum but have been gaining silent comfort for the past 7 months (Ridiculous. Lol. Receipt date Oct 23rd)

Just wanted to say, we had the same error message on my RFE for I-864. I panicked a lot and checked my photocopies of everything I had sent. Yes I did send all the pages, and yes it was the correct most-up-to-date version (the one on USCIS website is the most recent). This message is a default message I believe and it just covers all possible errors. For our case we hadn't included tax returns for the last 3 years but they didn't ever say that on the RFI!

Hope that helps you. We redid the I-864 form, included 3 year's tax returns and my husband's verification of employment letter and paystubs. We're now at 'ready to be scheduled for interview' but no other updates. Did you submit your EAD/AP application at the same time as the I-485? It has been a long time for you!

Hang in there folks and thanks for all your positivity and advice throughout the waiting!

I don't know why I ever contact USCIS. Every time I do, I hang up in tears. Just spoke to a tier 2 officer and she was soooo rude and condescending. I am currently out of normal processing times according to the USCIS website, and still no sign of EAD and no one at USCIS cares or has any answers and I cannot even submit a legitimate case inquiry without manipulating my PD, because the USCIS website which shows October 24 as the receipt date for a case inquiry is WRONG according to USCIS!! I need strength to get through this because I cannot take much more. I am going to have to cancel my wedding back home in October, which is DEVASTATING.

Sorry to hear this Nikki. We just had to cancel our wedding 'blessing' back home as well - but I was super hopeful and it was all planned for June 1st! That is NOT going to happen. October is still possible no? Maybe you feel like we did that it is too much stress not knowing. You gave it 1 year which you'd think would be time enough. Jeez this is brutal.

My RD is Oct 23rd and I just had same error message from submitting case inquiry. Have you been in contact with congress representatives/senators? I got responses back from both of them, although it hasn't changed anything on my case. It was nice to talk to some real people trying to help :)

I'm going to give it a few more weeks. We're having a 200 guest wedding, so I need time to pay for it. I did hear back from my Congressman, but all USCIS told him is that my case is at the National Benefits Centre which is no new news. It's the most brutal process. What bothers me the most is how people get on the spot approvals at the interview, and also people who applied after me who already have their EAD. How is their case even being looked at before mine?? It makes no sense. I STILL have not been able to submit a proper case inquiry (without putting a false PD) and it's now 7 days past my PD. And we've already had out interview!! You would think that would be a light at the end of the tunnel, but nope. It's like it never even happened. I feel like it's a conspiracy or something. I'm unable to submit a case inquiry, and I'm also unable to submit an Ombudsman inquiry because the form doesn't work for me. I've never felt so helpless in my whole life.

I feel you! Someone in the forum said they were scanning the cases before theirs and I started looking at other immi forums but they all just caused me more pain. My advisor at the college (as I'm changing from student visa to green card) said this is a new policy that USCIS is requiring the cases to all be given much greater scrutiny but yes this should still mean scrutiny happening in chronological order! The lack of logic is definitely the most upsetting thing. I don't mind waiting in a line as long as it seems like a fair line...

I heard something about government changing immigration to a more points-based system. I believe this is something Canada and the UK already have so maybe in the future having a degree, career and multiple job offers will mean something! No comfort for us right now though.. Nikki you said your husband has a pretty good job? Mine is working for the county so we get good benefits but it will be a serious struggle if I can't also work after June 3rd..

My congress person said it's still within normal processing times (as we know the website is not accurate) and the senator said my case is under 'extended review' on Thursday. This threw me into a right tailspin. Hopefully it's just the green card and the AP/EAD will be unrelated. I am going to ask them to find out what that means. I'm worrying now that I sent too much information in initial package - affadavit from my parents supporting marriage, photos etc... maybe they are overwhelmed by paper!?

My only comfort right now is feeling relieved we decided against the party. My mother was getting pretty hard to deal with so at least I don't have to have any more arguments about flower arrangements, seating plans, dresses, hotel rooms! Ha. My husband is also pretty glad he doesn't have to go through it all again. I had 5 guests from UK at Minnesota wedding.. but it was small and nice actually. A glorious sunny day.

Anyway, thinking of you. We'll get there. I'm learning to code in the wait... haha
