Hi! Relatively new user here, and I've been a lurker for awhile, but something came that required me to step out of the shadows. Just know that everything you post, any encouragement you give, has helped me a lot in this long and arduous process. Really glad this site exists! 😃

 

So onto my question. It's been about a month since our NOA2 was issued, so I requested our case number from the NVC through email, which they provided. However, I'm concerned that they refer to it as an immigrant visa, even though the K1 visa is a nonimmigrant visa. I also did a status check on the CEAC website, and our case number only showed when I selected Immigrant Visa. Nothing came up when I selected Nonimmigrant Visa. It shows as "At NVC."


My understanding is that for immigrant visas, there are six steps I as the petitioner have to do before the NVC can proceed to the embassy stage. But it's not an immigrant visa, though they seem to be processing it like it is. I'm concerned that the case is stuck at the NVC because it's classified as immigrant, because they're waiting for forms that I shouldn't have to submit, since it's a nonimmigrant visa.

 

Also, I noticed on the travel.stage.gov website that it says this:

 

Email (immigrant visa inquiries only):  Public Inquiry Form
(Note:  the NVC is unable to respond to nonimmigrant visa inquiries by email or fax. Please see our Contact Us page for contact information.)

 

Meaning I shouldn't have even received any email response from them since it's for a nonimmigrant visa, but I did.

 

Has this happened to anyone else? Or is the K1 visa at this stage actually (for some reason) classified as immigrant, instead of nonimmigrant? I apologize if this is an overdone topic that I just haven't seen yet. I just don't want there to be further delays because of something on my end.

NVC and the embassies treat a K-1 like an immigrant visa because they are handled by the immigrant visa unit at the embassy/consulate. It is still non-immigrant, but most often you'll see it listed under immigrant visa sections.

So even though it says on our case status:

 

"Please follow the instructions you received from the National Visa Center (NVC) that list the six steps you must take before NVC can schedule your visa interview appointment. This includes submitting to NVC various fees, forms and documents. Once NVC has received all the required items, they will let you know if anything is missing or incomplete."

 

That doesn't apply to us? And we should just wait for them to send the necessarily materials overseas to the foreign consulate?

 

Just want to make sure this is what every K1 filer sees when checking status. Because if it's not, I will probably have to call on Monday to ask.

I never got that notice, but there is nothing for NVC to do with an I-129F except to assign a case number and forward to the consulate. The normal immigrant visa steps at NVC do not apply to your case.

 

It won't hurt to follow up with NVC to confirm, but usually these types of messages are just generic for anything handled by the immigrant visa unit.

Ignore the message. it is just a regular for immigrant visas and does not apply to k1.
