K2 Child in home country, mother in Dubai

Hello everyone,

 

Was advised that this might be a better place to post this question.

 

Our I-129F just got approved.  My fiancee's daughter is 18 and still living in the Philippines.  Mother is living and working in Dubai.  I've been searching and cannot find a definitive answer on how to proceed with the K2 visa.

We were planning on fiancee doing interview in Abu Dhabi.  Will the case then have to be transferred (after the fact) to Manila?  Or, will they send the case to both consulates?  I did put the daughter on the I-129F.

 

I've been reading more and some have said that the child over 14 will be required to attend the interview with the mother, depending on embassy.  We just need to know for sure.  I cannot find any answers on the consulate page.

The child was listed on the I-129F,  so there is not much to do after that.    I don't know that the case file will be transferred to Manila, but that isn't an issue as the case file is digital also.

Thanks for the reply.  I guess the daughter will just have to attend an interview at whatever embassy the mother puts on the daughter's DS160.  The only issue I can foresee is how long it will take Abu Dhabi embassy to transmit the case to Manila.

In your case, it is best to have your case transferred from Abu Dhabi to Manila. Since your I-129f just got approved and when you receive your NOA2 letter, you NEED to phone the NVC at least 10 days AFTER the approval date. The average time to ship and receive (from USCIS to NVC) is 10 days. They can’t help you if they don’t have it. Mine took 20 days. If they haven’t received it after 10 days, try calling again 2 days later until you get the case number. Then you go to ask/NVC.gov (google it) and use the public inquiry. Fill out the form there and state your request and reason for the request. Be sure to attach a copy of her passport and noa2. 

 

FYI, I am in the process of transferring from Abu Dhabi to Manila. I have not heard from them since my request (3 business days). From what I heard it will take a week or two as NVC will have ask permission at the embassy you wish to transfer.

Well, the issue for us is that the mother will be interviewing in Abu Dhabi.  So, we have to wait until that's done before the case is transferred.

Update!

 

We were unable to get any kind of response (email) from the consulate for this question.  Also, they do not answer the phone.  So, we just did the DS-160's and set up for her to interview with her mother at Abu Dhabi.  Worst case they would tell her she couldn't apply there and have to transfer the case over to Manila.  

 

They had their interview this past Sunday and now both have visas in hand.  She was there with the mother on a tourist visa, in Dubai.

 

For anyone that might face this rare situation in the future.

(For those coming down the pike: the K2 could have interviewed in Manila with the mom in Dubai, a designated guardian would have to accompany the K2 to the interview)   

 

 

Hopefully both are flying directly from Dubai to the USA

This is local custom for working in the MENA region. When working there as a government employee you will have Friday(Holy Day) and Saturday off, all the while working on Sunday as well.

Thanks!  Yes, Sunday for them is like Monday for us.  They will be returning to PI first before coming to the states.  Fiancee has to give 1 month notice at work as part of the contract and the child's tourist visa is up soon.

The good thing as a Federal worker working there on Sunday is that you get extra pay for doing it.

Of course.  The mother has had to do the CFO before for work, so she mostly knows the drill.

That was for OFWs. So it's a different class altogether.
