Hey everyone, I just wanted to get some feed back as im about to go crazy with all this. I started this journey back in September 2017 when I filled for my petition. I met my Fiance from a facebook group chat back in February 2017. We talked, video chatted etc.. Finally went to go see him (Yes same sex relationship) in july of 2017. Stayed for a week, everything went great! Went back for my second visit November 2017 stayed 9 days again.. Moving forward, Filled a petition September  2017. I hired a lawyer..because i drive a semi truck and was always driving.. Now I finally submitted all that paperwork and she sent it off to the uscis.. I finally heard something from them in APRIL of 2018 an RFE.. I was upfront with everything, I was charged BUT NOT CONVICTED of a lewd and lascivious act on a minor..NO NEVER HAPPENED! But i was arrested for it, spent 3 months in jail because I would not make a plea offer...I wouldnt plea to something i didnt do! Anyways- case was DROPPED because no evidence and my nephew...yes newphews story kept changing...anyways I went to my hometown 6 hours away and spent almost 150 on court documents, all with seals stamped on every page and sent that back to them.. Showing, case dropped etc.. Website updated and said we received your documents.. had that message for months! Finally it changed to:

On July 19, 2018, we transferred your Form I-129F, Petition for Alien Fiancé(e), Receipt Number *********, to another USCIS office. That office now has jurisdiction over your case. We sent you a notice that explains why we moved your case. Please follow the instructions in the notice. If you do not receive your notice by August 18, 2018, please go to www.uscis.gov/e-request to request a copy of the notice. If you move, go to www.uscis.gov/addresschange to give us your new mailing address.

 

Still no change, and the website shows 71 days since last update..

Moving forward- I went back to the Philippines where he is from just a few weeks ago.. September 4th-12th 2018. While I was there 

The lawyer I have sent an inquiry and I just got a letter stating its still in review.. I hope this isnt bad news for me... I did everything I was supposed to do, I was honest and everything! I mean for work driving a semi, If i can get onto a military base  where they have nuclear warheads.. bringing  my fiance here shouldn't be so hard should it?

 

To be honest, I just need desperately some words of encouragement. The lawyer tells me it should not be a problem...but if it wasnt, I would be approved already i think 😞 

 

Ive visited 3 times to the Philippines have pictures, hotel stay, plane tickets, i mean what else can I do>?

Did you mention the arrest in your original petition when you first filed? Any crimes need to be disclosed at the beginning. Did you answer "NO" for the question that asked if you were ever arrested, convicted, etc. and then when they ran your background as part of the process they got a " Hit" on your record, sent you an RFE asking for all the court documents. You honestly should have included all of those when you first applied for the K1 and sent the paperwork in with the original I129F. You have obviously taken care of that now from what it sounds like, and I don't think they will hold that against you too much, but it could be an issue because you didn't disclose it in the original petition.

 

Hopefully someone on here has gone thru the same thing and can help you out more. The only concern is that you might not of mentioned it when you filed, but like you said, the whole thing was dropped, so that is the good part. Only bad thing is you didn't disclose it right away, and they came across it in a background check. I think you will be fine, but now it is a wait and see game. I would think things will continue on now once they verify everything you sent. I agree with the lawyer, I think you should be fine, but this is a tough question, I think just hold on and see how it plays out. The website is not the fastest in the world for sure. also make sure you are using the " NEW" website, you should be able to find the link here, or I might have it and I will post it below. You have to create a profile, and you get a verification text every time you sign in, if you are not doing that you are on the old site for status updates.

I’m guessing your petition went to Vermont(?) because that where cases with criminal background usually go. Although it also depends on the nature of your charges(was it DV or such sort maybe?). and they’re doing additional background checks due to this new information.

You need to have a lot of patience with the immigration process. It can be frustrating and very stressfull at times. Try to stay positive and understand that it is a waiting game.

Yes I did disclose this all in the initial petition. Now what I didnt do was send the documents with the seal on it. They stated they wanted everything to do with that case. So i did what they asked. It just saddens me that the process is taking so long. I mean a year already and im not even half way through this whole ordeal 😞

Well as long as they get the original sealed files they should move forward with the case and you'll find out one way or another. It's been dragging the last year or so as time lines with USCIS fluctuate every few years it seems. Just try to be patient right now as hard as it can be,

I appreciate you all, Its been such a nerve racking experience this far.. Just having to deal with those issues of the dropped charges, I thought all that was behind me, it just brought back so many bad memories.. I lost my father while i was in jail and to be taken back there and the past brought back up.. makes me so depressed.  But on the other hand, Thank you for telling me to have patience and just wait it out- its hard when you have to tell the fiance that you still havent heard anything and how discouraged they sound 😞

Once you get past USCIS it will go by quick don't worry. Even the NVC stage is short by comparison. Then especially with dealing with the medical and embassy in Manila, they are generally very easy going.

Yes. We had a pretty smooth process fortunately and quick, within 4-5 months after us it started slowing down but, the embassy in Manila is very easy going again. We rushed to get him here two years ago almost just for Thanksgiving.

You are so lucky! Its so hard on me to visit like I want to, you should know that its so expensive to go there each time. Im just a single guy with only one income, But im doing my best to show him and the dang government that we want to be together and for us to be happy. We video chat atleast once a week (would be way more but their internet there is just terrible) and he does not have lots of money to load more data, but we do chat everyday in messenger. I just cant wait for the day where I can finally tell him my flight is booked and im coming to bring you home!

Oh I know all about the costs, been three times myself. We are going back next April for a visit for his family, plus I never have met them in person even haha, so that will be nice.

 

I know all about the internet issues don't worry also. I would send money time to time to help him reload his credits for data.

 

Most Filipinos aren't "well off" or anything, maybe for my husband he was in a better position as to having a call center job. Previous J-1 internships in the US; but he had debt to his family also for college, the internships and all and he is still paying them monthly abit.

 

I let him fly alone honestly. He had traveled so was no big deal to him plus he wanted to go the long way haha. He went Manila to Dubai (just to see the airport and take pictures) then Dubai to Dallas, Tx.

Haha I want to be there and bring him back, but honestly if he could come by himself, I would do that...But hes never been on a plane, never had to battle customs..or even know what a connecting flight is, and if you have only say an hour to find your gate...Ugh so many things i can think of.. I myself have been there 3 times too. Every time its a little over 3K. I always stayed at the crown plaza because it was close (sorta) to where he lives in Rizal. About 5 miles but has to ride a Jeepny and I know he dont have money like that.. And yes i also send money to help out when I can.

That's mainly why I let him travel himself cause he was used to it. So that is understandable.

 

Customs isn't that bad, just takes time. Took him almost 2-3 hours to get through because of the processing and all with the K-1 packet. I just drove up to get him from Dallas though from Houston.

 

And yea, depending on what flights you choose or whatnot do to airline or layovers. I've been stuck in Seoul on a layover for 9 hours, China for 13 hours to save money. One was $1500 roundtrip, other was $1200 roundtrip, and last was $1600, only in part cause some were last minute purchases. We are planning ahead for next year and booking the flight soon cause its about $1500 round trip for two through Taipei.

 

Then when I stay in the Philippines I tend to pick cheap local places that are like $14 a night but still decent. Try not to go too over board haha.
