USCIS made an error on my GC which now delays my naturalization

As of last week I am in a tough and unique spot - I entered the country on a IR-1 Greencard in 2012 with no restrictions.

 

In April of this year (2018) I submitted my N-400 for naturalization, all was going well, I got my final letter to for my interview.

 

I arrived at the center and was all ready to take the exam and such, however the officer let me know that they will not be able to continue with my naturalization process as when they had issued my greencard it had incorrectly been given the status of IR-1 with no restrictions when it should have been CR-1 having restrictions and having had me file a I-751 many years back.

 

He stated that until I submit and am approved for the removal of restrictions by filing the I-751 my case is on hold.

 

I was able to receive a letter from the field office Director confirming that it was a processing error on their end and that I should submit my I-751 within 30 days.

 

I was able to get my I-751 submitted the very next with an overwhelming amount of evidence; 8 years of marriage and 2 kids....

 

I am concerned with the I-751 being so late, 6 years late, as well as the effect this is going to have on my naturalization time line. I am imaging at least a 2 year delay. Though I am sitting on on constant pins and needles till I hear more about my I-751 application.

 

If anyone has heard of a similar scenario, some comfort would be greatly appreciated.

OP, had you been married less than 2 years when you entered the country?

This is a good reminder for people who accidentally get 10-year card when they should get 2-year ones: you have to get it fixed.

I was 10 days short of 2 years - that's how the made the error on their end

But you should have caught the error too - you knew it hasn’t been 2 years since you got married when you entered the country. 

 

File I-751 and once that wraps up finish up naturalization.

I'm not denying that it is something that I should of caught, however did not . Between moving over with our son, two dogs and buying a house and such it happened

I filed the I-751 24 hours after I was notified

I think you should just relax and wait. Nothing is on fire, you are not here illegal, time is on ticking out 😁. You have lots of evidences and about your marriage, kids, jobs,.. ect. Most likely you will get approve. You also have a letter from them saying it was an error on their end. Proccessing time is always long especially now, with Trump policy rumors floating around. Just have to wait. Once you get your removal done. You can pretty much get on with your naturalization. Thing just take a little longer than you plan. If you live close to an USCIS field office, get an appointment, go see them in person. I find the people there are extremely helpful and very knowlegable. Google uscis appointment. I hope this help you feel better.

Once I get the confirmation and processing notifications for the I751 I'll make an appointment, thankfully it's only a 45 minute drive away.

They offered you an option to correct (their) mistake so you should be fine. You've got this (already submitted the I-751)! I've seen much worse cases, e.g. when USCIS approved a GC while the applicant's PD was not current. Those can end badly. But, while it's understandable that you're very nervous about it, your case looks pretty much bulletproof and you're taking all the right steps. So relax and wait.

04/15/2016 EAD/AP combo card received in mail.

12/01/2016 Prepared package for EAD/AP renewal (expires 04/09/2017)
12/23/2016 USCIS suddenly changes several forms, invalidating my EAD/AP renewal package (not yet sent)
12/27/2016 USCIS suddenly reforms the entire NIW criteria system, replacing a 20 years old one. Uncharted waters. 
01/07/2017 (Saturday!) EAD/AP renewal package with new forms received in Phoenix "reception desk"
01/17/2017 EAD/AP renewal case accepted; text/email with receipt numbers was received
01/30/2017 Law firm finally confirms that USCIS has suspended processing all EB2-NIW cases due to new criteria. 
02/23/2017 USCIS slowly starts adjudicating NIW cases again.
04/21/2017 Extended EAD/AP received in mail. Valid for 2 years. 
05/06/2017 Received a massive RFE on I-140 NIW case.
07/20/2017 RFE response received by USCIS (a very long response with 30 pages of docs)
09/14/2017 I-140 NIW approved!!! 
11/28/2017 RFE for new medical issued (plus another request re Supp J for employment which is clearly issued in error)
12/04/2017 RFE received in mail
12/07/2017 repeated medical exam for I-485
12/08/2017 Attorney receives documents for responding to I-485 RFE

01/12/2019 - submitted online e-Request for non-delivery of NOA (the extension letter)

01/24/2019 - received the response to e-Request via e-mail, which says: "Please allow 30 days from the date of this correspondence for the notice to be sent".

01/28/2019 - received NOA (the extension letter), which extends GC for 18 months

01/29/2019 - received biometrics appointment letter

02/08/2019 - biometrics completed

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
