Not really. Have the petitioner ensure the petition of the original I-129f is canceled/withdrawn or has officially expired then apply again.

08/15/2014 : Met Online

06/30/2016 : I-129F Packet Sent

11/08/2016 : Interview - APPROVED!

11/23/2016 : POE - Dallas, Texas

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

Timeline

If the petition got approved at USCIS and later denied at consulate, then you might need to get a waiver (but this should be simple as new petition is for the same person)

  •  "You are filing this petition on behalf of your fiancé(e), you have previously had a Form I-129F approved, and less than two years have passed since the filing date of your previously approved petition."

If the petition got denied at USCIS, then answer would be no but still include a cover letter to explain why

  • Yes
  • Something like this: "I filed I-129F petitioning for the same beneficiary with assigned case # YSCXXXXXXX as it was denied because my finance and I did not meet the requirement of physical visit within 2 years. We now meet this requirement, thus, I would like to file new petition for my fiance..."
  • Include a copy of denial letter for previous petition
