New Adjustment of Status Applicant Need help

My partner is a US citizen and we recently got married in August but have not yet started the AOS filing. We really don’t know much about how to do it and are now thinking we may have to get the help of an attorney to help us put the paper work together. I am legally working in the country.

Does anyone know know of any flat rate attorneys in Houston Texas? We really need to start this filing but it seems so overwhelming.

Thanks for the help.

Unless either of you have certain criminal records (etc.), there is no need for an immigration lawyer; thus it can be DIY: https://www.visajourney.com/content/i130guide2

As long as you were inspected and admitted (or paroled) by CBP at POE, and either your visa was dual intent OR it was nonimmigrant intent and you didn't have prior intent to AOS.

So that we can provide the most accurate info, what is your current status?

I am an H2B worker. My contract ends October and have successfully gotten an extension to continue working till May of next year.

I don’t have any problems with the law or had dual intent as I come to work here every year.

Might I add that my partner lives in Texas while I am currently in South Dakota. My job extension unfortunately will be in Florida,so I am not sure how we are going to do this. Hence,I need some guidance.

Living apart for work reasons is common; here is a thread (one of many) about living apart for work: https://www.visajourney.com/forums/topic/265686-living-apart-after-marriage/

Wherever you live in the US, you file the forms at the USCIS Chicago Lockbox. On page 2 of the I-485, it asks for the mailing address; this can be your partner's address in Texas, if you wish. On page 4, it asks for your physical address at time of filing and your past physical addresses for 5 years. When you want to update either the physical address or mailing address after filing you use Form AR-11. If your partner (and joint sponsors, if applicable) move, they file Form I-865.
