You need a legit reason like mostly medical emergencies for the process to be expedited or like if your petitioner is in the army otherwise it’s same as everyone that we have to wait. My pd is 9/14/18 from texas service center. I asked for mine to be expedited since I just gave birth to our daughter. Technically it’s not a medical emergency since nobody is ill like dying illness. And the fact that Trump wanted to close the US embassies from international countries and trying to close the border it affects everything. Let’s just hope and pray we could get through this hardship of waiting to be reunited with our loved ones.

There's a list of reasons to expedite. There was only talks in shutting down USCIS employees at US Embassy, but there was not official word. That wouldn't affect anyone's I-130s It would affect those that live in countries that allow DCF though.

There is a list of resons for expedited petitions but the most used is the medical emergency and if you don’t have that category they won’t expedite it. Yes it’s still talks but Trump is going crazy about the border. I’m hoping September filers soon get rfe or approvals 🙏🙏🙏🙏🙏🙏

I've seen plenty of successes for other reasons other than medical. Honestly it's all BS. LPR's are getting petitions approved only to sit at the NVC stage because visa limitations prevent them from progressing, but here we are USC's waiting to petition spouses, or family on the back burner.

Thanks, I am tracking what is needed for an expedite. I received one my first time through and have valid reasons for an expedite this time too. Just waiting for USCIS to approve or deny it. I really don't believe the Mexican border will affect any of us at all, since most immigrants use airports as their Port of Entries. Good luck.

I agree. From an outsider's point of view, it makes no logical sense why PR's are approved faster. They still have to wait for their PD to become current so that extra few months doesn't shorten their overall immigration timeline, while with USC it can mean being reunited with their spouse a few months earlier. Maybe there's a good reason for it but there's no chance that USCIS would ever share it with the public so I just try to ignore it.

Good luck getting your expedite!

Thank you!

For all of the NEBRASKA SERVICE CENTER filers... a lot of us are sending in complaints to our representatives, due to the backlog of case (they just set their processing time back 2.5 months) and the fact that there's a big difference in processing times between centers (Nebraska is taking the longest, apparently).  Please consider doing so, if your forms are in NSC!

Is anyone familiar with this new policy about RFEs and NOIDs that came out Sep 2018?

https://www.uscis.gov/sites/default/files/files/nativedocuments/USCIS_Policy_Update_on_Issuing_RFEs_and_NOIDs.pdf

Does it mean that petitions after Sep 11, 2018 wont get an RFE but a direct denial ?

Sounds very scary..... My PD is Sep 20 :(

I came across this long time ago. But reading it in detail right now it seems it is only meant to discourage frivolous filings. Meaning if you are missing multiple things or something very important. It goes on to mention innocent mistakes are okay. Also it is completely upto the adjudicator.

I would say as long as you submitted everything from the checklist here:

https://www.uscis.gov/system/files_force/files/form/i-130instr.pdf?download=1

you should be fine. Nowhere here lists wedding pictures, phone call logs etc. these will not prove a bonafide marriage. Yes you can/should/must take these to interview as they will be of high importance. But uscis doesn’t ask for such things and will not deny your case if you didn’t send these additional things. Yes if the adjudicator is almost certain but want just that lil more proof I think he will issue an RFE for additional evidence regardless of the article above.

Yup meaning more US citizens filing for petitions

Actually the number of applications as a whole have declined over the year. The House Democrats and American Association of Immigration Lawyers has contacted the USCIS Director with this issue as we are now in a legal immigration crisis. Applications have declined and processing time has increased.

I got my wife's passport back from the IRS and the ITIN letter is being delivered today.  This morning they accepted my tax return so my refund will be in the bank within 21 days.  I am hoping that I get it while I am there visiting.  She was worth $7,700 additional refund so I think she deserves some treats!
