I did the K1 visa a few years ago. It was approved and my husband had his green card and everything. But it expired since we stayed outside of the country too long. I think depending on the reason of denial or it expiring, it shouldn’t affect your case. Our I-130 was approved this time.

Yeah but in our case beneficiary is still in india she didnt get her visa bcz our case had passed the time period. Mine was approved by uscis . Now we are in Cr1 processing. we are worried if it affects our processing or may be it will delay our case, ☹️

It will not impact the speed or delay the processing.  Your K-1 was denied because of lack of response to the 221(g).  That was the only reason so now just relax and let this happen.  You will be fine.

Forgot to post this but this was basically their reply

I emailed my congressman also and they sent me an email to complete a privacy notice so that they can look into my case. I didn’t even bother to complete it, I know I’m gonna get the same answer and the same excuse and don’t even want to frustrate myself any longer with this so nothing else to do but just wait. Eventually they will get to us.

Wait?  Someone is complaining after just 5 months?  CR-1 is 12 to 14 months.  There are 3 to 4 months at NVC.  That leaves 7 - 9  months for USCIS.  People in the K-1 groups are more patient than the CR-1 and the CR-1 groups knows this takes longer.  Relax.  They will get to you.

My K-1 took 270 days to NOA2 and that was about normal.

I agree that people need to relax. I've seen in a few threads now people making inquiries WAY before they should. USCIS tells us approximately how long it is going to be and they give us the date on which we can start inquiring. It's not much information, nor is it super accurate, but that is how USCIS has decided it works and we have to live with that. Do I wish I could be approved faster? Of course, everyone here does. But inquiring before that date just takes USCIS's/their congressman's time away from people that have legitimate problems (or are legitimately outside of normal processing) and makes it harder for them to get help.

I know a lot of people are reaching out because of the increase in wait times, and I agree that it sucks, but not a single part of this process is fair. Is it fair that Potomac is processing MUCH faster than the other service centers? No. Is it fair that Texas is processing much faster than Nebraska? No. Is it fair that people are still getting their cases sent to Nebraska even though they are clearly behind? No. Is it fair that wait times are getting longer and USCIS doesn't seem to care about it at all? No. I could keep going but the fact is this is something we all signed up for, fair or not, because we want to be with our spouses no matter what and this wait is unfortunately part of that "no matter what".

So maybe this wait time has just made me cranky, but people need to stop making inquiries/contacting congressmen before they are out of normal processing, because even though one petition is a tiny drop in the millions of petitions they get, every petition that is approved because someone complained and got lucky makes the process even less fair for everyone else.

Well stated.  No one promised this would be quick and easy.  It is what it is and the process is the process whether we like it or not.  I understand wanting to be done but the focus should be on the reason for the process, not the process itself.  It certainly $uck$ but is there a point when it really becomes too long?  If there is a point where you would quit the process because it is taking too long you should just consider quitting now.  I started in June of 2017 and it this takes 100 years just to have one day with my wife with me in the states, I will gladly wait.

It makes me mad that Permanent Resident's petitions are processed before U.S. Citizens. I feel like citizens should have the priority here. Just my two cents. I have requested an expedite on 29March2019 and received an email 01April2019 (10 AM) asking for supporting docs. I uploaded them the same day around 11 PM. We will see what they say.

I agree. From an outsider's point of view, it makes no logical sense why PR's are approved faster. They still have to wait for their PD to become current so that extra few months doesn't shorten their overall immigration timeline, while with USC it can mean being reunited with their spouse a few months earlier. Maybe there's a good reason for it but there's no chance that USCIS would ever share it with the public so I just try to ignore it.

Good luck getting your expedite!

You need a legit reason like mostly medical emergencies for the process to be expedited or like if your petitioner is in the army otherwise it’s same as everyone that we have to wait. My pd is 9/14/18 from texas service center. I asked for mine to be expedited since I just gave birth to our daughter. Technically it’s not a medical emergency since nobody is ill like dying illness. And the fact that Trump wanted to close the US embassies from international countries and trying to close the border it affects everything. Let’s just hope and pray we could get through this hardship of waiting to be reunited with our loved ones.
