All September 2018 filers...hoping to get approvals soon for everybody. By the way, how did you guys (American Petitioners) file/will file tax returns? As single or married? What was your experience doing so, was it straightforward or complicated?

Hi!, we still haven't tackled that. I know if you want to do it jointly and she doesnt have a SS, you need to get an EIN for her o him and that takes from 4 to 6 weeks, so you would lose a lot of time in the filing. But it is all preference.

Anyone heard anything? we called yesterday and requested to speak to a Tier 2 specialist which told us our file was touched on 01/23 and that everything was good with out documentation, but that was all the information that we got.

If your spouse is not in the US, you can file married filing separately. The part for SSN you would have to print it out, write Non alien resident and mail it in. You do not need to apply for ITIN

My spouse isn't here and I filed Married Filing Jointly.  She is worth $7000 extra in the refund so it is better to get her the ITIN and be able to use her as my spouse.  The process is easy for ITIN.  It is worth it too.  Without the ITIN or SSN you cannot get the spousal deduction.

I don’t see why it would be a NOID because I’ve heard it’s hard to get a I-130 denied since it’s a relative? (Unless they’ve done something bad). So probably a RFE! I’m being positive ❤️

You have an approved K-1 and you filed a CR-1?  Did you withdraw the K-1 before you filed a second petition?

We ended up moving to Sweden and his green card expired because we stayed out of the country for 15 months. So we have to file the CR1 but turns out we received a NOID. And it was because they need our marriage certificate and my birth certificate.

Packet 3 Received : 12-04-2015

You comment reminded me to check my taxes again and I think you saved me (Thank you!). I have filed every year since I've been out of the US, but realized a fatal mistake! My CPA has done them as SINGLE every year, since 2011. And I stupidly didn't check to see if it was correct. Looking at our email chain, I implied to him that I wanted "married but filing separately" but he understood this as single. But what's done is done... I will have  him refile the last three years, because that's the maximum amount of years allowed to refile. I feel really stupid about this situation and that I have to pay for refiling, but better correct it now than later, I suppose.

Does anyone think that the years 2011 - 2014 filed as single will give me a lot of trouble with USCIS or NVC? I looked at other threads here discussing this but opinions seem to be divided.

thanks

September 18th, 2018. Nebraska service center....I have a feeling I got stuck with the slowest processing center.  Traveling back to India next week for the 7th time since we met. This process is very challenging, and I feel that most people never truly understand the commitment, sacrifice, and determination it takes to be with the one you love.
