Hello again,

 

My fiance and I filed and got our NOA1 on August 6, 2018. We want to spend Christmas and New Years together. However, I don't have enough vacation time at work to visit him this year so I have to wait till Jan 1 to get my new vacation time. He is from Canada and our plan is that he would be here for a week, we would go back to Canada together and I would stay for a week... We were wondering if he would be able to visit for a week in December since we have already filed? He does have a job and we would have all tickets purchased to also present as evidence that he would not be staying but i'm not sure if that is enough evidence or not.

Yes you can visit, my Canadian beneficiary has visited me and vice versa with no issues. Some people bring proof that they plan on returning to their country i.e. letter from employer or landlord. We didn't do that and there was no issues. He even visited me here without a return flight booked yet and had no issues.

Only USCs are guaranteed entry to the US. His entry will be based on CBP's discretion. To try to convince CBP about his intent to return to Canada, he should travel with evidence that proves that (the more the better).

Okay, besides a letter from work stating that he still works there and the purchased tickets, i'm not sure what else he could use as evidence. He currently lives with his dad and doesn't pay rent as he is allowing him to save money to move here. Do you think those two things would suffice?

Okay, thank you. There has only been one time he was interviewed while trying to cross the border and that was when we drove back to my state and he didn't have a job. He will be flying here so I think we will be okay. I may just have him bring evidence just in case!

Timeline

Hi there. I live in Windsor and my fiance lives in Michigan. We both cross multiple times a week to see each other. We don't mention the k1 Visa just that we are visiting each other and never once had a problem.

I live in Toronto and my fiancé lives in Florida, and we've visited each other multiple times since the process started for us! If they ask, be honest about it and you should be fine. :)
