your petition now will be sent back to the US and allowed to expire / you can not appeal this decision

your only recourse is to return to Turkey and marry and file a CR1

many of us have had this happen and we know the hearbreak

be sure the new photos include Turkish family expecially the mother as you need to show proof the family approves

take note that a religious or big age difference will be under strict questions at next interview

Baghdad and Islamabad each had more K1s issued than say Amsterdam and they are on opposite lists. I dont see how quantity is a determining factor, especially in OPs case. I believe there is more to it than what we know.

Amsterdam does less interviews

I also wanted to ask that. I can see why a low count of visas issued can be an eyebrow raiser but what if there were not enough application to make to the Embassy stage? There were only 10 in Lebanon for August, but I've yet to find more than 1 person on this whole site applying for a K1 from Lebanon and they just got approved. I'm worried now, though. lol

That would be an easy Slam Dunk for everyone else then. In other words, no need for a K1 visa and maybe not even a CR1 from abroad.

Much easier and Much cheaper to just apply for a B1-B2 and marry here. Make sense? No USCIS, No fees, No NOA1, No NOA2, No NVC, No Interview, No Months of waiting, No Ap and No Nada... But, you could be very right and I wish you nothing but the best of luck in your journey.

Trust me, I am not hating what so ever. Westerners and Canadians can get here with almost No Visa, but still go the course. Make sense???

And how do you know how many Interviews Turkey has in that period of time for k1? They don’t give the overall amount.. I’d love to know it....

To the OP: I believe as many others said, the problem lays on not having enough evidence of ongoing relationship between time the petition filed up till the interview. Sending Iictures taken after the interview actually might have looked like it was forced because you had no evidence before they asked for it.

no, having b1/b2 visa won’t effect k1 process. 

 

I’d suggest trying to go to US, if you’re ok with it moneywise, cause there is a possibility they may not let you in. But there is also a possibility of them letting you in. This part is 50/50 as always. Have your documents showing your ties.

be honest if asked. so that the worst case you two can get married in Turkey.

We filed a petition for K-1 Visa on August 2017 and we got our NOA2 on February 2018. In 45 days we were able to get our interview at the Embassy. Somehow, officer requested more information (we believe absent of photos caused problem). Following days we shared 90 photos that we sent to each other during our relationship. After few weeks, we finally get an e-mail stating that officer decided to sent our case back to USCIS for "possible revocation". We asked many times for official reasoning behind their decision but they did not provide and kept telling us to contact USCIS when our case is returned to them. We sent the Embassy photos of us together at vacation, and asked that can we come in for interview but they said officer made their decision our case is going to sent back. To this date still our case is "Under Review" at Embassy website.

 

It has been over 5 months since our interview date, still our case is at the Embassy sitting on a desk. When we pointed this out recent weeks, they told us, our case will be returned when administrative process is completed and that we may resubmit our petition since it has already been expired. USCIS and Department of State telling us, until they receive our case back it will not start to expire.

 

How come a petition can expire without even being processed. I might be wrong but I do not think we will be able to file new petition without withdrawing current one.

 

We feel like Embassy is not being fair with us. Is there anything we can do in this situation? Can we report this to somewhere like Department of State?

Did the two of you meet up before filing the K-1?  It sounds here like you did not meet in person until last month?

TM92, you advise OP to come to the US and say he/she had a K1 and they are here to marry and go back?

Exactly. A K-1` is not needed to marry. No status is...even EWI travelers can marry fine.

Intent to AOS is the difference. K-1 permits this. B-1/B-2 does not.

No I am not certain what this person's intentions are, as I am not this person. 

 

However, It is not illegal.

 

Just like someone else coming to any other country, let's say going to Turkey or Amsterdam or whichever country they go to... And they won't be getting married over the sea on a non-binding international waters. They need to get married somewhere.... It is not illegal to marry in US. many people do. So I see your frustration by going through the right routes and waiting forever, which I also feel the same for people who lie and adjust their status. I want to believe this person. and give them the correct information without making them feel even worse by blaming them for something they didn't even ask for.

Not everyone is into taking photos.
