Yes, FMLA does offer you legal protection. Workers in America don't have many rights but at least this is one of them. 

 

OP, I'm sorry for your situation. Start applying for new jobs, so that soon you'll be attending job interviews as well, not just a green card interview. Not all employers are tyrants like yours, unfortunately, there's not much legally that can prevent US employers acting like yours does. 

 

Good luck on your interview! Don't try rescheduling, I've read some horror stories on here.

As other have said "yes they can"

You know your work situation better than anybody else.

I don't know if you have shown them the Appointment letter, or would that make any difference ?

Sometimes there is no good answer, just the lessor of two evils.

 

I wish for you the best and I'm glad I would not be facing such an issues.

Welcome to America and “at will” employment. I’m seeing this at my workplace with someone whose absence has caused a write-up. Where I work, our handbook states that the fifth unauthorized (I.e. not planned) absence in a 12-month period leads to the first stage of disciplinary action. The final stage is termination of employment. Check how many times you can be absent before you get to this stage. From what I’m reading, this is only the second (the car accident being the first). 

 

It it does sound like this could be the employer’s way of getting rid of you and making it look like you’ve gone something wrong rather than having to say to you “I’m sorry - I don’t think you’re right for this job/company”.

Look dude, you do you. I was simply stating that the right advice was given multiple times on this thread - speak to HR, get it handled. The situation isn't unique. Employers aren't forgiving, especially when they are a large business that has to enforce the same policies for every employee.

 

It sucks that he was in a car accident and has to use his PTO. The fact remains that his state is an at-will state and they can fire him at any time.

 

How would you like us to sugar coat the facts? Jeeeesus.

If the boss does like you, there is very high chance your boss will fire you with/without any reason.  You can get something today but if he (or she) still holds a grudge on you, it will not be a good life: find a new job.
