Hello, do I have a chance to be approved if my husband and I were separated if we apply for my adjustment of status? We had disagreement after we got married and we talking to each other again due to the in laws from my husband we can't still be together because they always in the way between us.   I'm from Philippines and my husband is white. 😢

You can, mean kind of have to otherwise will become out of status and technically legally removal by deportation.

 

You both need to sit down and someone needs to be an adult and say "enough is enough" with whatever the problem is. If it's living with the inlaws, move out. Finances shouldn't be the issue for this as it is something you needed to be prepared for long before going through the process.

 

If it's them interfering, he needs to man up and tell them to butt out as it isn't their marriage. Someone needs to take charge of the situation and be an adult.

 

If it was my family doing it to me, whatever it is exactly. I'd tell them to get lost.

You can only adjust through your asawa.

Adjust from K1?

 

Short answer is no. The conditions of your K1 is that you are coming here to be married to your husband. Even though you have married you still do not have any official status. That means you need your husband in order to adjust your status (you must provide proof or being married and also you husband must sign the affidavit of support). If you and your husband don't get along and he does not agree to and sign the affidavit, then your adjustment of status will be denied.

 

You will then be stuck in the US without status. Even if you found another love who is a US citizen, it will be difficult to be able to adjust status through them. So basically, your options would be to return home or live in the US illegally.

Sounds like you need to sort out if your marriage is going anywhere.
