Well back from holiday and we are completing wife’s online n400.

 

I am sure this has been addressed but I’ll ask anyways.....

 

Travel/Residency/Education is based on 5yrs not 3years. 

 

Since we are filing based on 3yr residency and marriage we only complete info for 3yrs starting once she arrived?

  • Marriage base, it is 2 years and 9 months from the issue date on her conditional green card  
  • Filing N-400 may help expedite the conditional removal. Condition must be removed  prior to or concurrently with N-400 approval.

Well we are aware of the requirements... the questions on the N400 are obviously based on 5yr applicants not 3years.  So when the applicant only has been a resident for 3yrs it doesn’t make sense to include info when they were not a resident.

  • Check 1B on N-400
  • Physical address - you can include 3 years in US and 2 years in Vietnam.  USCIS will know why it is the case.
  • Same with employment history - 3 years in US and 2 years in Vietnam.

Part 5. Information About Your Residence List every address where you have lived during the last 5 years (including other countries) prior to filing your Form N-400. Start with where you live now, and then include the dates for each place you have lived in a month, day, and year format (mm/dd/yyyy). For example, type or print May 1, 1998 to June 1, 1999 as 05/01/1998 to 06/01/1999. Provide your mailing address if it is different from your current address. Provide “In Care Of Name” information, if applicable. If you do not have a State or Province, enter the name of your city again in that box. If you do not have a ZIP or Postal Code, enter “00000” in the ZIP or Postal Code box

The form is written for the standard N400 application. The 3 year marriage based application is handled differently in terms of how it is adjudicated going back only 3 years.

 

For the purposes of the N400,  those questions are to determine if you meet the physical presence and continuous residence requirements. They only care about travel/addresses/employment since becoming a permanent resident. If you want to list all the info before becoming a resident, that's up to you and can be explained at the interview (I don't recommend adding the foreign info in, however, as it can confuse the IO). The interviewer will likely cross out the information going back further than the 3 years since the application cannot be adjudicated based on the older (ie. foreign residency) information.  For any criminal history, however, they need information going back the entire life span, and even then only the last 3/5 years can be used towards fulfilling the Good Moral Character requirement (if any criminal history is present) when pending approval/denial based solely on criminal background.

 

Some people retain their LPR status and are approved to temporarily live in a foreign country for whatever reason.  If that is the case, then yes, you would list the foreign residence address as noted in the instructions above posted by the previous member.  Other than that case, the above foreign address info would not apply to you.

Just a bit of clarification to the first bullet point.

  • It is 90 days prior to conditional card expiration. Not 3 months. Many might say there's no difference from 3 months but when USCIS can deny a petition for being just a few days earlier than the official 90 day period, those extra days in months that have 31 days can result in a package being returned.
