N400 Interview with no Green Card

Hello,

 

My husband's interview was finally scheduled, but there's one little problem. He has no green card. His green card was caught up in the recall mess back in May 2018. He sent his back and still hasn't received the new one with the corrected dates. He calls USCIS and we even reached out to our Senator. The only answer we get is that it's pending. In the mean time, he's been getting the I-551 stamp.

 

We got an email yesterday the interview was scheduled but we're waiting on the letter (to be uploaded or mailed) to see when it is. It seems unlikely he'll have his green card by that point. Will that cause any issue at the interview if he has the letter granting 10 year residency and the I-551 stamp?

It should not be an issue since the card is not in your possession due to a USCIS error (and the physical card recalled).

 

I would suggest bringing to the interview the letter you would have received from USCIS regarding the green card being recalled and that it was requested to be mailed back to them.  If you have copies of the correspondence received from the Senator's office regarding how the replacement card is still pending, bring that as well (to at least show you've made a good-faith effort to have the physical card in hand, if questioned).

 

There is, however, still a possibility your husband will receive the physical card before his interview.  Generally there's about a month's gap inbetween the interview letter being mailed out and the actual interview date.

As @Going through as said and I will reiterate is that it should not be a problem at all because it was recalled due to the USCIS error and not yours. So bring the paperwork with you to the interview showing that it was recalled and you should be fine.

My wife had her GC taken when she went for her I551 stamp prior to her N400 interview.  At the N400 interview, she showed the IO the I551 stamp and the IO had her sign an affidavit regarding not having a physical GC.  It was not an issue at all, but make sure you keep your copy of the affidavit as it will be needed at the oath ceremony.

Thanks for flagging this! He's gonna renew his I-551 stamp soon so he'll be sure to hang on to that.
