Investment in Cannabis Industry - Immigration Status

Hi all..

I moved to US from Canada with K1 visa and am currently living here with my husband as a conditional permanent resident. We have been married 3 years and I have applied to get the conditions removed. I'm currently waiting on the next step as due to backlog my current residency has been extended twice.

Now to the main concerns - we have been a bit confused about how investment in the cannabis industry might impact on immigration status for a while. Recently I came across news suggesting Canadians who work or invest in the industry will be barred from the U.S.

https://www.thestar.com/news/cannabis/2018/09/13/canadians-who-smoke-marijuana-legally-or-work-or-invest-in-the-industry-will-be-barred-from-the-us-customs-and-border-protection-official.html?utm_source=Facebook&utm_medium=SocialMedia&utm_campaign=600pm&utm_campaign_id=Cannabis&utm_content=CanadiansMarijuanaBarredFromUSDALE

My husband (US citizen) had stock investment and we have shown all that in the financial documents that we submitted. While I have made no investment in the industry, in Canada or US, do you think we should be worried about this? It's very confusing and vague in regards to effective when was this an issue or effective when is it going to be an issue. Do you think this is why my case isn't moving? If it turns out to be so.. what kind of legal steps do we need to take or should we look into?

Thank you!

are you MARRIED or ENGAGED?

regardless, it bans CANADIANS who are involved. If its not in your name, I wouldnt worry about it. Also, you say you are already a permanent resident, so doubly no need to worry about it.

We are married. I am a permanent resident but conditional though.. I was under the impression they can take that away anytime they want.

Im not sure anyone will have 100% answer. Why not sell the stocks and then its gone.

how long has he had it? if its been in all your paperwork from the beginning, theyve already seen it. I also dont think this is a new policy, simply coming into the spotlight because of the upcoming legalization. The US (Federal) has never looked kindly on marijuana in any form.

But again, if its not in YOUR name, im not sure i would worry about it too much.

Truly its all fake news. If you are overly concerned sell all shares as somome mentioned. I know lots of people who are actively involed in the capital creation industry for cannabis and spend tons of money multiple times a year in various USA cities. Their spouses even in work/study visas in the USA while they are helping grow the industry in Canada.

That said the US CBP should never publicly say this, that would be rather silly and a slipperly slope. Nor would any cannabis venture capital person who carry a pound of kush on to the plane now.
